Full Version: PCN Contravention Code 1 - Merton Council Restricted Street

Hi Guys,

Bear with me first post on this forum! Have parked my vehicle on a single yellow line in the borough of Merton at 8:45pm yesterday evening. Apparently the road was part of a restricted zone, however on the turn off the main road there were no large signs designating this as a restricted zone.

The road in question is Graham Road SW19. I was pretty much directly opposite house number 171a - The parking attendant observed at 20:43 and timed contravention at 20:45.

I have looked at a few previous forums and believe I have a case to contest the ticket. Happy to take it all the way if needs be. Any pointers or advise of people in the same boat would be more than grateful!

All the bays are permit onlt til 11 pm further down the road abot ouside 121 is a no waiting til 11pm. don't know if that is far enough away to constitue inadiquate signage others will advise

Looks like in a CPZ
Though which one or where the boundaries are not sure.
This may help locate.

Parking bay times will have no relevance nor SYL restrictions on other single yellows that may have their own pole signs.

Try backtracking your route in to the road and seeing if you can find CPZ signs you may not have seen.

Put them to strict proof that correct signage is in place. Remove their butts out of cosy offices.

Looking on google street view there is no clear CPZ entry signage from the A219 southbound to the B285.

Graham Road does not have an entry to CPZ sign either. Have decided to contest it on that basis.

Do I have any hope of winning?

Well, I reckon a drive by would be well worth while. With a Camera.
Looking at the detail map of W4
http://www.merton.gov.uk/cpzw4_may14.pdf which I assume is dated may 14 going by the file name.
There should be entry signs as you turn from Kingston into Hartfield Lower left corner of outline
Yet on Streetview (dated Sept 2014) I'm seeing none

There is an entry sign behind, just before the level crossing but I can't read the times. They don't look enough to cover the differing restrictions Mon to Sat and Sunday though. And only one on one side of road is inadequate.

If you can show that you could have entered (you do not have to say you did) without passing adequate CPZ signs, you win.

There are signs by the bus stops on both sides of Hartfield rd as you drive up it from Kingston road but there other entry points that do not look as compliant

If they put them on the junction they would probably missed as you turn in an as its DYL there is little point and they'd serve no purpose. The OP should have just parked on the bus stop on the right as it has no time plate! laugh.gif
