Anyone heard anything about this bunch of cowboys and in particular St Annes Pier car park, Lytham St Annes Lancashire? My daughter got caught out last week, couldn't find the ticket machine and she told me that the signs were very small, and badly placed; almost "deliberately so" in her opinion. She took some photos which I hope to post later. She is not alone though, see the link to Tripadvisors reviews of St Annes Pier below and the car park comments in particular.

From what I understand APS UK Ltd have only been going for 12 months or so and there seems to be very little on this and other parking forums.

Apart from being written by a three year old, it contains an interesting snippet about the commission they pay clients on their tickets.
£20 per ticket according to their 'self-ticketing' page.

The driver saw neither your woefully inadequate signs nor any payment machine

I require cancellation of the notice or the validation code to refer it to POPLA

If it's not a company/lease/hire car wait for them to waste £2-50 to obtain her details from DVLA and send her a Notice to Keeper
They may make further errors in the process

Update.
The Registered Keeper has now received a "Reminder Notice-Parking Charge Outstanding". We will reply with the letter drafted above by Gan (many thanks). Two points 1/ Should the RK name the driver? 2/ There were indeed mistakes on the Reminder Notice, the time stamp on the photo differs by "several hours" to the time that the ticket was alleged to have been issued. We are NOT planning to mention this at this stage.

No, why would you name the driver?

Did it arrive within the timescales for keeper liability? Does it allege keeper liability? Does it comply with the content requirements of pofa2012, such as naming the creditor, and exactly replicating the notice to driver?

Yes, they had 56 days from the date of the incident to get this to you. Did they succeed?

If they didn't, then are they still alleging Keeper Liability? If so, naughty naughty.

Today is day 57; from when you posted and as such there is no longer any keeper liability. It is crucial that the Driver is not named.

How does the keepr get a reminder? is there a link of the chain missing or is this the NTK

You have failed to maintain to the strict limits required to hold me as keeper to a liability.
your only recourse it with the Driver.
I have no compunction to assist you in that.

Reminder Notice to RK arrived 49 days after date of "event", I assume that this is the NTK although it doesnt say so? This was the first document to be received other than the parking ticket attached to the car back in January. Reminder notice attached.

Remove the notice number from the payment slip in your picture

Your allegation is not only unreliable but you have failed to meet the requirements of POFA Schedule 4 Para 8(2)© to hold the keeper liable
4 The amount you have demanded cannot possibly represent a genuine pre-estimate of any loss to your company

Furthermore, I note the statement in your reminder letter that you are authorised to collect the payment on behalf of your client.
Regardless that I deny any debt, your unnamed client would be the creditor, not yourselves.

Update to this case- my daughter never got a reply from All Parking Services when she challenged them back in March, however she did get three "demands" from Debt Recover Plus ( June, July) which I told her to ignore. Nothing since so pretty sure this one is now dead and buried? Thanks for all the advice.

If you asked for and did not get a POPLA code, you could ask the BPA to investigate. Email is aos@britishparking.co.uk. Insist they send in one of the Area Manager to audit All Parking's processes as they must have a record of this. Failure to maintain records could lead to All Parking being banned from the DVLA database as the belief in the reliability of the audit system is paramount.

If the BPA fail to investigate then complain to Communities and Local Government that the BPA are failing to take their duties as an ADR seriously and you believe a single ADR is required now.
