Full Version: Failure to send paper licence when paying speeding fine

My son was caught doing 44 in a 30 zone by a mobile speed camera. No complaint with that. He was given the option to accept a fixed penalty which he did. When he sent in his fine he failed to send his paper licence. Being dyslexic and dis-organised he had lost it. He has now been sent a summons to appear in court and has the option to plead guilty by post. He had 3 points I presume for the speeding. Is there any way that they can levy any additional points for not sending in his paper licence. He has only had his licence for 18 months and if the give further points on top of the original 3 he will lose his licence. Any advice appreciated

If he didn't comply with the fixed penalty off (by sending in all of his licence) then he won't have any points yet. He can ask the court to impose the same penalty (3 points and £100 fine) but they don't have to.

Right now he has no points as he failed to comply with the fixed penalty, at court they will set the points based on the speed and limit, although he would have an argument for the court to only levy the fixed penalty tariff as the reason it wasn't accepted was due to administrative difficulties unrelated to the offence, though the court may not accept that argument as he had the clear option of accepting via compliance.
