Hi everyone,
Firstly thank you all very much for any help I want to receive and I need any help from you about my trouble of PCN.
Please understand I cannot write everything specifically to avoid being identified myself from PCN sender.
I have received a PCN from Parking Eye at Welcome Break for parking a time over 2 hours.
I've read a few similar topics on this forum, Although reason and parking time spent are different from titch02 case, but other things (at Welcome Break, amount of charge etc.) are quite similar.
So I am aware that there is the template letter for appeal. However I don't know where the latest one is and it does work for my case well as well as how should I do.
To be honest I don't have circumstances and custom in UK enough, with regard to car trouble because I am a temporary resident in UK (engineer being seconded from parent company base in another country).
Please could anyone tell me how I should treat with this PCN?

Talking to welcome break is a good idea, if you have a genuine reason for staying there. They can always cancel

Is it a company car or is it your own?
Simply write saying that you were unaware of the signs as English is not your first language. Invite them to cancel or send a POPLA code. Advise them that your address for service will be outside the UK soon.
The non-UK address means they will have little chance of going to court as they are unlikely to get any money from someone who is not a full time UK resident.

Thank you very much for quick message. Actually I didn't park my car at Welcome Break (shops area). As you may know, there is a hotel in the Welcome Break area. I stayed at the hotel and my car was parked on the parking space of the hotel. The hotel and its parking area are clearly located individually from Welcome Break area. The hotel car park is free of charge in accordance with their website (and I didn't pay the parking cost at the hotel).
I can say I parked the front of the hotel and the hotel gave me car parking with free of charge, but I am suspicious it can convince the parking eye

Thank you very much for the kind proposal. It is not company car. I am a registered keeper, which mean I have proper UK address. In fact I will be UK at least until next April. In this case, are they likely to give up on getting money?

Given a 6 month window they could mount a claim. What does the Hotel say about it?
Usually there is a "genuine customer" clause in the contract so if the hotel confirms you were and the signs say "free parking" I cannot see the basis for their claim.
What are they saying?

Thank you for the reply. I haven't contacted the hotel yet, but they gave me free parking. Booking confirmation from the hotel (Email from Booking.com) clearly shows it. There is no receipt to prove my stay because the hotel didn't issue the paper invoice, but the cost was charged to my credit card and it is on my transactions.
I will contact the hotel first.

I would send a copy of the booking confirmation to PE. If you can highlight the free parking bit. You should also add that there was no loss to their company and their recent failures at POPLA appeals confirm this + emanresus points. You should also as already advised contact Welcome Break with a copy of your booking reference and your pcn. They should help you with that.

Write to them (ParkingEye) either in a letter of via their website with the following:
Dear Sir or Madam,
I am the Registered Keeper of vehicle with registration mark XYZ and am in receipt of your speculative invoice. I can confirm I was the Registered Keeper at the date of the alleged parking event, xx/yy/2014.
I am appealing your charge as it is clearly an unenforceable penalty and thus void.
Please thus cancel the charge or provide me with the means to refer the matter to POPLA.
Should I not hear from you within reasonable time I will assume you have decided to cancel the charge.
Yours faithfully,
XYZ

Get some screenshots when submitting this online, or get a free Proof of Posting when dropping off the letter at any Post Office.
Once they reply come back here for further advice - but they are simple to beat and you will not pay anything.

Dear all,
I called the hotel reception and told the receptionist about the PCN. I was required my detail to be confirmed I stayed at the hotel, in the end the hotel emailed PE for cancel request of the PCN I received. I have got the copy of email. I should not do anything anymore, just ignore the PCN, the hotel said. I was a bit worried the hotel doesn't help me or is not cooperative. However the hotel (Days Inn) was very helpful with me and they are completely familiar with this type of contact.
I hope this annoying matter was sorted out!
I very thank all of your kind and prompt helps. If I wouldn't have your helps, I might stuck or just pay the charge.

Well done. I wonder how often this hotels employees have to waste time having to send over 'evidence' that a customer stayed there to PE?

Don't forget to send the letter that matt285 has given you. Sometimes despite being told, PE continue. So send the letter and get confirmation from PE or get it cancelled at POPLA

I made the appeal on PE website in accordance with the suggestion of emanresu, I referred the template with slight modification which matt285 provided. And I attached the email which the hotel reception sent PE to request the cancellation of my PCN.

As I wrote the car park of the hotel is completely separated from Welcome Break car park. However almost guests need to access there by car from motorway. It may mean that all hotel guests suffer from the PCN attack or I suppose the hotel might forget to send the cancellation request because I told my registration when checking in.

We have seen this con before by ParkingEye in Aberystwyth. It appears to be a method of bullying a potential client so that these "errors" can be avoided. Drop a line to Parking Prankster with the background to it.
