Full Version: NIP 39 in 03 MPH

Hi All,

I received a NIP a few days ago for going 39 in a 30 MPH zone.
I don't know what would be considered as invalidating the NIP - I have attached a copy and would be grateful for any suggestions.

At the moment your requirement is to complete the relevant parts of the form naming the driver and return it within the required time frame .

Keep a copy and get a Proof Of Posting from the Post Office .

If it was delivered within 14 days of the alleged offence and specifies the nature of the offence with the time and place then it's valid.

I did try to complete the NIP wizard but it stopped me at some point and said it could generate the output - even though i didn't put in anything unusual...

Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I was driving along the road, do not specifically recall this event.

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). For the record, I am the driver of the car but the car is in my company name so the NIP is addressed to the Company Secretary.

So your Co. Sec. replies naming you as the driver, and you will receive your own NIP.
