Full Version: Vehicle registered in my name and at old address but never owned vehicle

Hello, I'm looking for some advice.

I received a letter yesterday from a collection agency that have gone to court to allow access to my property to remove goods to pay a fine by the DVLA for not filling out change of keeper.

The problem is I have never owned this vehicle and have not lived at the address for ten years. It was my parents house and they sold it five years ago.

The collection agency have told me it was a discovery but the court and DVLA have confirmed it as a HGV. (the people who bought the house had horses so this would make sense)

Having spoken to the DVLA they have confirmed I was the registered keeper of the vehicle at my old address.

I am awaiting a call from Citizens Advice about the matter but wondered if anyone has heard of this before and how do I stop the bailiffs when they come as they won't believe it's not my vehicle.

I would suggest getting to a court ASAP and filling out a statutory decleratuion to the effect that you were unaware of the court case (the actual details of teh case are not relevant) as you've had no access to thr property for 5 years.

I'd also get to the Police and report the identity fraud, who know's what else they have in your name (loans, accounts, HP etc etc)........sooner reported the better!

And you accepted this even though you know it is not the case???

Are you saying someone had registered the vehicle in your name without your knowledge or consent?

If this is the case, for starters I would go back to DVLA and if you have not already done so explain exactly what the situation is and see what their response is.

Are you saying someone had registered the vehicle in your name without your knowledge or consent?

If this is the case, for starters I would go back to DVLA and if you have not already done so explain exactly what the situation is and see what their response is.


I have spoken to DVLA but they have informed me there is nothing they can or will do as it has gone to court.

I have also reported to police who won't do anything as they say using someone's else's name is not an illegal matter. DVLA will also not tell me if any other vehicle's are registered in my name.

You need to contact Sheila ASAP. Do not delay. Do not let the Bailiffs in your home. Lock the windows. Tell your family not to open the doors. Do not pay them any money. Take your car for a ride and leave it somewhere out of sight.

It's not just about Bailiffs - I will do all advised but I obviously also need to resolve the situation.

I have no idea who the person is, I have no knowledge of the car, have never seen it let alone owned it.

CAB say they have no idea what to do. Police and DVLA won't get involved. I am trying to ring the magistrates court but they never answer.

I have been informed by the police the bailiffs can get in anyway as it's a magistrates court order they can ring a locksmith to let them even if I am not there!

Of course it is if it's for fraudulant, mischevious or illegal purposes

Try and speak to Sheila ASAP! Forget what the phone answering chimp down the station says for now. Speak to an expert on Bailiffs and get some proper advice and help. First get the immediate threat of bailiffs coming to your house with the intention of clamping / seizing and removing what ever they can. Sort out the DVLA / Magistrates / Police and possible identity theft / fraud once your property is no longer at immediate risk of being clamped or seized.

If the OP could have done a stat dec that would have headed off the bailiffs anyway, I think THAT would have been a better priority to e honest!

As for the Police, get down there (after the SD) and make sure you talk to someone who knows what they are talking about, no-one registers a car in someone elses name without a good (bad) reason.... for example they ignored the S172 got off the speeding and you're getting punished, sounds like perverting the course of justice to me.

Simon is right. If whoever you speak to won't do anything make a complaint. A complaint MUST be recorded and should ensure something gets done. Come back if this happens and we can guide you through the best way of proceeding.

You must write to the DVLA with your full details explaining that you have never owned the vehicle do not know who the keeper is etc.They WILL remove your details from the database.This will ensure you will not be contacted.

1 get the bailiffs of by filing the statement

2 stop dealing with DVLA over the phone
(or they will just keep on spouting bollocks)
only in writing with the DVLA

re 1 are these DVLA fines done through Mags court ? (so need the court route to get set aside)

as others have said could be all kinds of ID theft goings on going on.
Of its more than just this DVLA issue then you will have a fair bit to do on that front as well .
