The authority's case is that the Appellant's vehicle was stopped in the box junction when prohibited when in New Kings Road/Bagleys Lane on 27 October 2011 at 18.09.

The Appellant's case is that there was no warning sign of the approaching box junction and that the box junction was not clearly road marked when he entered it and he was unaware he was entering a box junction.

I have considered the evidence and whilst there is no prescribed warning sign for an approaching box junction, I do find that the road markings of this box junction are worn and degraded especially at the point of the Appellant's vehicle entry.

Accordingly, I find that the box junction's road markings are too worn and degraded at the Appellant's point of entry to be enforceable.

The appeal is allowed.
