Full Version: Red route, stopped where prohibited in a loading bay

I’m posting this on behalf of a friend who has received a notice of rejection following appealing against a pcn for parking in a loading/unloading bay without the related activity within the restriction times.

She appealed on the grounds that the contravention did not occur as the sign gives exemptions to blue badge holder and at the time, she had a disabled passenger in the car, and displayed the blue badge; she was only parked there for 3 minutes. They rejected the appeal on the grounds that there was no loading/unloading activity and that there was no exemption for the disabled on the signage. This is not true however, as she was sure the signage did have the disabled sign on it as well, otherwise she would not have parked there. No stopping on any day 7am-7pm except 10am-4pm loading max 20 mins and blue badge holders, max 3 hours.

She has a photo of the signage at the particular place, which she found online, which confirms her assertion. However she also saw another photo on google maps of the signage without the disabled bit. Can she appeal to the adjudicator with the evidence she has about the blue badge bit? She can attain a copy of the blue badge as evidence that she displayed it and had a disabled person in her car.

In addition, their stated times on the NtO are even wrong. It said she arrived in the bay at 12:22:54 and drove off at 12:22:34 (this time is prior to the arrival time). This is not possible. Can it be added to the appeal grounds? What are the chances of her appeal being upheld in view of the above?

She has very little time left to appeal; immediate responses would be very much appreciated. Thank you

She's paid for the PCN, as she went back to the place to check the sign again. There are no exemptions for blue badge holders.

SO, what the result of the appeal (as surely your friend did one before 'chirping' up on this forum?)

@observation1, her initial appeal was rejected and she has since paid for the PCN, as she went back to the place to check the signage and noticed that there are no exemptions for blue badge holders.
