Full Version: No PCN given to me, but one might have been issued

I had a slightly unusual experience the other day.

I stopped on a single yellow line to pick up a passenger. A CEO can straight over to my car and started putting the details into his handheld machine, without saying anything to me.

I spoke with him and explained that I was picking up a passenger, but he said that I was not allowed to stop on the single yellow even when picking up a passenger. When I questioned this, he said that I was only allowed to stop for 2 minutes to pick up a passenger, and that he was going to issue me with a ticket, but that I could appeal it.

I left the vehicle where it was and went to pick up my passenger. I noticed that as I was walking away he drove away from the vehicle (on his scooter), and drove some distance down the road.

When I emerged with my passenger perhaps 4-5 minutes later, he had parked he scooter on the pavement some distance (perhaps 50 metres) from my car and seemed to either be writing in a notebook or doing something with his handheld device.

As I was walking back to my car, I am pretty sure that I saw him fiddling with one of the yellow envelopes that they put tickets in, but by the time I was seated in the car it had disappeared, he was just stood there, but seemed to be watching me. There was no ticket on my car. As I drove off he watched me leave.

I am quite suspicious that he might have issued a ticket but not put it on my vehicle, but wonder if I'm just being paranoid.

Is there any conceivable reason that he would do that?

If he has done that, I assume that I will end up getting a PCN in the post. If so, am I correct in thinking that I will then not have the chance to make an informal representation, and will only get the chance to make a formal one?

Also, what chance would I have of contesting on the basis that he did not serve the PCN? I believe that he had a video camera on his jacket. Could I force the LA to hand over that footage? It would definitely show him leaving my vehicle seconds after I left it, and would show that he had not tried to serve anything.

I don't want to waste your time with a PCN that might not even exist, but any advice on this would hopefully put my mind at rest.

Since the CEO that issued is unlikely to read this no one here can say if you are going to get a PCN or not, why not wait until Tuesday and ring the Council to ask them.

Give a PCN By post upto 14 days to arrive from the date of contravention

If you receive a postal PCN you can appeal on the grounds that the CEO was not prevented from serving a regulation 9 PCN. If you receive a NtO you can appeal on the basis that the PCN was never served.

By the way, you can stop to allow someone to board, but you can't wait for them to arrive during restricted hours.

As the others say - wait and see. Or indeed as Clark says, phone the council and ask them.

Hi Neil i notice what you said that i have made 3 posts and they are bollox i understand but i am a civil enforcement officer in plymouth since january and i feel i am failing and will soon be out of a jobs i am trying my best and on these forums i get abused but i dont know anything about PCN issued via post i only know issued at road side,i am just really worried about my job as it is,and this dosent help could you please teach me a bit about parking

As your LA hasn't taught you anything about parking what does that tell you ?

Do they want you to know the rules ? Or just issue tickets with very little knowledge (so rendering that pesky 'the CEO has reason to believe that the following contravention occurred' as mere window dressing)

Thanks bama going to look at these websites now but the local authority has given me knowledge on contravention codes and how to use a ticket machine

i dp try to keep the traffic flowing as best as i can but when it comes down to i have to issue the penalty charge notice i will issue the PCN
