You can write and ask for 'copies of any photographs which might assist with identification of the driver' (or similar). Whilst they are under no obligation to provide you with anything at this stage, most SCPs seem happy enough to pop a snap or two in the post if they consider the request to be genuine.

If you do write, please keep an eye on the 28 day response window of the s.172 request and bear in mind that a photo request will not automatically extend, suspend or reset this timescale.

With regard to not knowing who was driving, how many others could have had access to your vehicle at this time ? What steps have you taken so far in attempting to identify the driver ?

Was this in the dark or daylight?

It was about 7.30 pm (xmas eve) so pretty dark.
My sister and I were sharing the drive so can't remember who was driving at which bit - with the kids! I wondered if we named each other so we are not with holding information - does it normally go to court?
Gan
It's a near certainty that it would go to court and S172 charges are very difficult to defend.

Where are the places that you stopped to change drivers ?
Who put petrol in the car ? Used a phone ?

You'll have to show that you've done everything possible to ID the driver if you expect to convince magistrates that you can't remember who was driving through these roadworks on Chrismas Eve.

If the photos don't help and can't prove you wrong, a better option by far is to name the person more likely to be driving (but don't qualify it with words like "probably")

All S172's just about go to court....

IF 2 people named each other, unless there is some evidence as to which was driving, it would be very difficult to succesfully prosecute either, after all one is telling the truth and the other not, but which one?

What speed has been quoted?

Failing to furnish details will make your liable to 6 points and a nasty fine and penalty code.

Thanks for all your help. biggrin.gif

It's not unusual for the speed limit signs to not be compliant at night, they should be illuminated but I have 3 live complaints with the highways agency for failing to do this, worth checking to see if the relevant terminal signs are illuminated if they are within 50m of streetlighting as is required.
