Location of offence (exact location as it appears on the NIP: important): - A64 Seamer Bypass, Scarborough
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? - Driver of works vehicle
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Was travelling out of Scarborough on the A64, trees and bushes were down the left hand side of the carriageway, there is a layby on the left hand side which was indicated by signage, I saw the camera van at the very last moment as it was obscured by the vegitation, the van concerned was also imho indistinguishable between that of a camper van and that of a van with blacked out windows. There were no visable markings on the van that from a distance made it clear that it was a camera van.

Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Did the NIP have the alleged speed on it?

It did ocelot, 65 mph however it does'nt say what the speed limit is if that is of any relivence.

Forgot to add it was a van I was driving if that makes any differene ?

Whereas I'm not familiar with the A64, I would assume the limit was 70 if it was a dual carriageway (for a car), but the limit could have been anything from 30-60 otherwise. Have you any recollection as to whether it was a dual carriageway? The limit would be 60 for most vans, but not all.

Single carrageway NSL

Approx where I was pinged, the van was in layby just to the left of and in front of the LGV in the photo

I was where metes lane was approx before I saw the van where the truck is in the layby http://maps.google.co.uk/maps?q=seamer&...mp;t=h&z=17
My van is a Trafic so im assuming I should have been doing 50 tops ?

Yes. It's an outdated law that was seldom enforced until mobile scamera vans came into existence. However, you should be in line for a speed awareness course, if you haven't done one in the last three years, which avoids points but costs slightly more - probably worthwhile from an insurance point of view, though, if you drive a lot.

In the meantime if you want to check the "ping" was good you can write back and ask for photos "to help identify the driver" - NOT proof or evidence, which you aren't entitled to at this stage. Whatever happens, make sure you return the S172 naming you as the driver within 28 days.

Think im stuffed !

In a 50 limit the sac course is available to anyone doing 57 - 64 inclusive, so im 1 mph over !!

Yeah, definitely 50 it seems. sad.gif

I suppose you could do the usual asking for pics to try and waste a bit more time, but there is a long way to go until 6 months.
