What is the name of the Constabulary? -
Date of the offence: - May 2011
Date of the NIP: - 34 days after the offence
Date you received the NIP: - 35 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A140 Sweetbriar Road, Norwich, towards Hellesdon
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I am unable to recall the offence. I am the only driver of the vehicle. Caught on camera 50 in a 40 limit. Had the car 1 week. From telephone call I found that the NIP was sent to previous RK on time. But I was the RK at the time of offence. Therefore I was not informed within 14 days.

  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

The Rookie
The Police have to send it to the RK at their last known address of the RK, there is a specific get out if the details were not avilable, so if the details at the DVLA were updated AFTER the date of the alleged offence you have no 14 day defence. What is the 'docref' date on the bottom of page 2 odthe V5C - that is when the details at DVLA were updated.

Thanks for your reply Simon. Yes the docref is 10/6/11 so I suppose that is fair enough. Strangely though, through pure coincidence I was pulled over the following day, (27/5/11) in Edinburgh. I wasn't speeding just lost and was driving too slowly. They done routine check `to make sure car was mine' and all was ok. Oh well will send back nip. I am hoping to be able to do driving course instead of points. What the chances of this, at least its a day out.

Usual basis is not more than 10% + 9 mph over limit, provided you have not done one in the last three years, but entirely at police discretion
