Right so its been a terrible week for me...two tickets from the Westminster Nazis in space of two days!...not good!

Ok ticket No 1:

I'm guessing I don't really have a leg to stand on, and I suppose at least its only £40 and not £65..

Basically parked my car in a pay by phone bay at the evening of 20/05/11 when it was free (after 6.30pm). Overslept in the morning and got to car at 0841 and the traffic warden was just walking away having stuck the ticket on. Time of issue 0837minutes.

Any chance of an appeal?

I can't find the restriction to which you refer. I can see Res Only, shared use and PBP 24/7, but not PBP with free after 6.30pm.

Pl either post the street view or give number in Gloucester T where car was parked.

I like the 24/7 PBP - what a honey pot. The PBP sign is parallel to the carriageway immediately underneath, and dwarfed by, a zone entry sign at right-angles to the c'way which states controlled parking for M-Sat. Bet that's a nice little earner.

And pl post back of PCN (and for your other one as well).

Thanks for the quick reply hcandersen. My car was parked in a bay outside no 28 ( i think) Gloucster Terrace, Westminster.

Strangely, this is the exact location to which I referred and clearly you're a motorist who thought that the times of operation of the designated parking place were those displayed on the zone entry sign when in fact they're not.

AIUI, all parking places except meter bays within a CPZ which is indicated by zone entry signs must be signed with upright signs. Where a sign does not indicate days/times then the applicable restriction applies 24/7, not the CPZ zone times.

AIUI you could have been PCN'd at any time, but you weren't - the CEO waited until after the start of the CPZ time which makes me wonder whether he believes that this is the start time of the restriction in that parking places. If so, perhaps it is and the sign's incorrect. In which case you're in the clear.

I'd wait for others to comment, also try and confirm the writing on the sign (my info's based on a 2011 googlestreetmap view).
