The alleged offence is failure to comply with the statutory 70mph, namely at a speed of 98mph. I know that i shouldnt of been doing this speed and deeply regret it. Further more is is correct that the NIP should reach the registered keeper within 14 calender days or is it 14 working days?

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - No
Is the NIP addressed to you personally? - No

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • Do nothing!

The police are not requesting the information from you, they are requesting it from the person the NIP is addressed to.
Wait until you receive a NIP addressed to you personally, then come back here.

The first three points put on my licence on the 29/02/2008.

These are now irrelevant, as they were over 3 years at the date of the latest offence. So you only have 3 points now.

14 days, but as it is a company car who is the RK? More often than not it is a leasing company or similar & they will get the NiP first, so your first move is to verify who the RK is & check if THEY received the Nip within the correct time scale.
MJW
The registered keeper of the vehicle is my company. The NIP was forwarded via post to my company first and not the leasing company. The date of the offence was the 20/04/2011. The registered keeper (my company) recived the NIP on the 09/05/2011.

The only question is if the constabulary have 14 calender days or 14 working days to notify you of the offence.
BaggieBoy
Are you 100% certain the company is the RK? Have you seen the V5C document? Or has the vehicle recently been registered?

It's 14 calendar days BTW.

Were you agreeing or adding one to my number? cool.gif

Check the V5C document for the RK and tell us the DocRef date on page 2. I doubt your Company are the Registered keeper expecially as you state the NIP was " Forwarded" to the company. NIP's should not be Forwarded. Pete D

Please do not post personal details for obvious reasons - Travelling on the A74(M), returning from glasgow, i have received a NIP. the date of the offence is 20/04/2011.
They first notified the leasing company on the 22/04/2011.

I already have 6 points, will i receive another 6 for this offence.

- Yes
Although you are not the Registered Keeper, were you the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No
As you were not responsible for the vehicle, somebody else has named you as the driver. Were you driving? - Yes
Which country did the alleged offence take place in? - Scotland

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

Depending on your circumstances, you may wish to consider completing the form, but returning it unsigned. By doing so there is a risk that you will be convicted under s172, which would attract 6 penalty points and a fine; in most cases this is likely to exceed the penalty for the speeding offence itself.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

They only have to notify the registered keeper within 14 days of the offence. There is no further time limit and they do not have to send an NIP to the driver at all.
The Rookie
The only NIP is to the registered keeper, legally anything after that is not a NIP (despite what it may say on it) but is usually an S172 request to name the driver.
