Date you received the NIP: - 28 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A46 Sedgeberrow Bypass towards Evesham (LC), CE25 Hinton on the Green
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - Not known
If your are not the Registered Keeper, what is your relationship to the vehicle? - Hirer of vehicle
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Whilst travelling along the A46 I saw a stationary vehicle on the opposite side of the road with what appeared to be speed detecting equipment in the rear.
I received a NIP but with my christian name spelt incorrectly. I assume they got these details from the hire company. My name is spelt incorrectly on the hirer database also.

  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

I guess the NIP was sent to the Hire Company, or the lease company who supplies them.

It may be worth checking to see if the "first" NIP in the chain was received within fourteen days, although they issued yours after only twenty-three days, so late service is unlikely.

You might like to write requesting photos to help ID the driver. Don't mention proof, or evidence, as you're entitled to none at this stage. The photo might show how you were detected and the quality of the "ping."

Asking for photos doesn't stop the 28 day clock, so make sure you return the driver's ID form within the allowed timescale. Recorded/special delivery around day 26 would be best. Keep a copy of the form you return to them.

Spelling your first name wrong isn't going to be an issue as you will have to complete the S172 requirement with the driver's full, correct details.

As this appears to be a speeding offence can you tell us the limit and alleged speed?

On the NIP it states ..........

Excess Speed (50mph) Class of vehicle (under 7.5 tonnes) - manned

Contrary to S 86(1) & 89(1) RTRA 84 & Sch 2 RTOA 88 the speed 57 MPH.

I've no doubt it was me as I can remember seeing the police van and thinking s***.

I just wondered if because my name was spelt incorrectly whether the NIP was invalid?
