Was the NIP sent by first class post, second class or recorded delivery? - First

Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - According to the notice I ran a red light by 1.25 seconds. I do not remember this event whatsoever. My mother was also in the car and also doesn't remember the event. I am always careful to stop for a red light, though I have been known to continue through on an amber light. I am dubious as to whether this event actually occurred.

  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Normally, red light cameras are activated 1 second after the red has appeared, after this point if ANY part of your vehicle crossed the line, the camera will be tripped.

You can contact them to request a copy of the photo to assist in ID ing the driver, do not use words like evidence/proof, they do not have to show them but normally do. They are worth seeing, I recently set off a RLC on the M40/A46 junction when the light was green at 4 AM & no other traffic about. I heard nothing so assume someone looked at the picture & saw it was green, some possibly do not get looked at ohmy.gif

The other possibility of course is that you did cross at red sad.gif, the photos will confirm which it is.

Remember that you MUST return the S172 naming the driver regardless of anything else to avoid 6 points plus hefty fine for failing to furnish.

The amber phase is 3 seconds (+- 0.25) so this would have you passing the stop line over 4 seconds after amber was shown. Request photographs "to identify the driver" (do not use the words "evidence" or "proof"), if they send them you will be able to see if the offence really happened (which it probably did, as red light camera detection is usually correct).

To be honest I don't know. My company keep the V5 so I'm assuming they're the registered keeper with the fleet company (Hitachi) being the owner. I got a call from our transport department on Tuesday last week asking if it was myself or my husband (the only other named driver) driving it on that day. It was me.
