What is the name of the Constabulary? -
Date of the offence: - October 2009
Date of the NIP: - 11 days after the offence
Date you received the NIP: - 12 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A385 near Lownard Cross Dartington
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0

Please do not post personal details for obvious reasons - driving on a long country lane 40mph restricted. apparently entered a 30 zone and was booked by a manned camera.
I didn't see a police van/car or a copper.
Will be returning to scene in next couple of days, as I am not sure exactly where this offence was supposed to have taken place..
What are the rules regarding 30mph limits?
this one is out in the country and as far as I can recall no street lights , the placement of the restriction seems to have been for a couple of nasty accidents at a minor road crossing the A385

If there are no streetlights, then it must be legally signed and have regular repeaters. You need to return and take a look at the signs.

Thanks for that..
Now, been back, no streetlighting. nearest is over 100m from sign around a bend in a side junction. the sign is unlit (not that that matters i got done at 14.30 hours)

How far away can the camera be? and what distance do they need to "clock" you in?
I didn't see the camera or operator .and there are signs and a telegraph pole which cover half the distance from the 30mph board and his position.

When do I ask for photo evidence? do I do that within the 28 days of the 172 notice? or doesn't it matter.

They can be up to 1000 metres away when they "ping" you. Asking for photographs does not stop or reset the 28 day clock, so do it sooner rather then later.

the problem is , you cant see more than 100m half of which is obscured by posts,
the road dissapears from view down a dip. cant see the road at all beyond that.
its national limit beyond anyway...
the booking actualy occured in the first 100m of the limit, it goes over a little rise and out of sight..

cant understand where the invisible copper was, can they leave a camera and come back or does
it have to be "manned" like it says in the s172

Ask for any photos that may "help to identify the location and the driver".

Don't use any words like "evidence" or they will refuse.

This won't stop the S172 clock so you must still return the form shortly before the deadline. Use recorded delivery and keep a copy.

If you were very close to the sign when you were pinged it will be worth tracking down the Traffic Order to see if the sign is in the right place.

The distance quoted in the Traffic signs manual ......."Table 14-3 Minimum clear visibility distances for terminal signs"....
are these mandatory or are there other factors that can be taken into account?

the speed limit sign is 30mph from national limit on the A385 and is visible for about 100m before the signs.

got google earth pictures of area, cannot be the 150m quoted, sa there is a bend and trees obscuring the view........what do's anyone think?



one other thing.

A 30mph speed limit start sign , no street lighting, does it have to be illuminated??

oh yea the offence happened during the day

If there are no streetlights within 50 meters then the speed limit sign is not required to be illuminated.

I drove one way to the town, my partner drove back and we are not sure which way the booking was caught... as we only stopped for a short while.

We have just got home and now have the photo evidence. 3 pictures of the back of the car, cant see driver or anything else for that matter. Still dont know where it occured !!! do the photos have gps data?

no, they only show the rear of the car from 1 foot outside the near side light to about 1foot inside the off side light, cant even see the whole back of the car.
i've no idea where it is taken or even if it is in a speed limit!!!! all I know is it was at 2mins past 2 !!
