Full Version: Newton Hearing = Full Disclosure ?

Hi
This one is for all you legal beagles

I pleaded guilty to driving without due care and attention in the Magistrates Court, because the prosecution version of events differed from mine it has been adjourned for a Newton Hearing / Trial, does this mean I can receive full disclosure of the evidence against me, statements / video ect, and would this disclosure be enforced by law ?

yes you can rely on full disclosure by the prosecution so you have a fair hearing

the newton hearing is where whislt the fundamentals of the offence are not disputed
matter of fact are disputed and these have a substantail bearing on sentencing

eg you admit exceeding the speed limit but dispute the actual speed
the spped being the prime derterminant of the penalty
