The PACE witness statement first appeared on this FightBack forum exactly one year ago today (Jones v dpp thread 8th February 2004) and, to date, we are not ware of anyone who has been convicted of an offence.

The first case that came to court as an S 172 prosecution, was mysteriously dropped by the Crown, at the last minute.

Furthermore, the first speeding prosecution that we are aware of, did not proceed either and the defendant’s legal aid funded specialist in criminal law, has apparently taken to the PACE argument “like a duck to water”.

The PACE witness statement is now two years old:
    To date, there has been a great deal of bluff and bluster but only a very few actual convictions.
    To our knowledge several Forces, including the Metropolitan Police, have never issued a summons to a person who returned a PACE witness statement.
    We have a High Court appeal and the layers in that case, will be asking for the matter to be referred to the European Courts of Justice who, unlike the British courts, understand how to apply International Law.
