Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I was in outside lane heading to junction in slow moving traffic, probably doing no more than 10 mph. Apporaching junction I was distracted by my children in the car, as I re-focussed realised the ligts were changing, checked mirror and junction then breaked once realised safe, and came to a stop over the white line but no intruding into the road crossing the junction so not being a hazard to traffic, and not forcing a pedestrian into a dangerous position either. Although I knew I had overshot the white lne at the time, mainly because my 4 year old son queried why I had not carried on, I was still surprised to get this NIP. I am also aware the junction will also have been the subject of road traffic CCTV recording.

  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Sadly, the offence is complete when any part of your vehicle passed beyond the white "Stop" line when the red light was showing regardless of the fact that you did not continue. In all probability you will be offered a fixed penalty if and when you return the completed response to the NIP. Contesting the issue is, IMO, unlikely to yield a substantially different outcome and would necessitate at least one trip to court.

Thanks HO87 - it's what most of my mates have told me. The kids have apologised but it's my nights out that will pay for it - not theirs!
