  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. i have seen the pictures and cant see most of the line markings to determine my speed due to the angle of the flash would this allow the prosecution to be waived?

Probably not, no, the original photo is likely to be of a much better quality than the cruddy copy you have.

Its only a requisite that the secondary speed check can be performed anyway, not that you can see the lines.

Was this a Gatso or a RedSpeed camera. Wash the ID and reg off the photo's and post them in your thread using the the instructions in the FAQ section. Pete D

think it was a gatso what is the difference?

the pictures are on hertsfordshires web site i will try to get them and post as you asked

Gatso Type 24 fixed cameras were originally approved for use without any lines painted onto the road surface and, AIUI, those initial conditions of Type Approval for this device remain unchanged to this day.

It needs to be possible to perform a secondary chcek, not (as nemo points out) see/have lines per se....

Its certainly very hard with those photos, the lines also look more like redspeed than Gatso (Gatso lines are not fixed though, so scammers can pant what they like as long as its usable!), can you look at images on google and confirm which you think it is? Although when I used that road a while back, it is from memory, Gatso.
