What is the name of the Constabulary? -
Date of the offence: - May 2008
Date of the NIP: - 11 days after the offence
Date you received the NIP: - 12 days after the offence
Location of offence (exact location as it appears on the NIP: important): - Limehouse Link Tunnel W/B E14 (005)
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 3
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I think I was driving, but it may have been my partner, we were making several trips back and fourth that afternoon as we were organising a party with catering. We are just not sure who was in the vehicle at that time.

  • Complete the Section 172 statement naming the person you believe was driving.
    You aren't incriminating them - they'll receive a NIP to complete themselves in due course.

Failure to inform the police of who was driving can lead to a bigger fine and more points than you'd receive for your FPN.

A good game of rock, paper, scissors could help decide who takes the points.

Which could lead to hotter water than failing to provide driver details, if the police were to decide that the OP had knowingly nominated an incorrect driver..

You need to do everything which could be reasonably expected of you to attempt to identify the driver of the vehicle at the material time. In the first instance, you should write immediately to the police and request 'copies of any photographs which may assist with identification of the driver'. No need to embellish or elaborate at this time.

Whilst waiting for the photo(s) to arrive, have a search of the forums for other similar cases to give you an idea of what you might be against. This article is a good starting point.
