Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First

Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I was travelling down a multi lane road, there were two cars driving like nutters (drifting across lanes, possibly racing each other) In order to clear myself of any danger I increased (slightly) my speed to clear them. As I approached the lights they were on amber. I had to decide if I should slam on a possibly cause a crash due to my heavy vehicle or try and get through. I decided to go through. They went to red just as I was going through. The alternative was to cause a pile up!

I did not see a flash.

NIP says I was doing 54MPH. That is so far off the mark!

Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

If any part of your vehicle passes the stop line while the red light is active, an offence is committed.

confuses me. you out accelerated the racing cars in your heavy vehicle ? ?

Sorry, should have made myself clear. I changed lanes and accelerated to avoid their weaving around each other. The increase in speed was a few MPH. :-(

I understand that and I expect that is what the NIP is for. But what about the speed? Is that a seperate matter? They have quoted that on the NIP too. Am I gonna get hit with a double whammy?

No.

The camera records the passing of your vehicle against the red light. The speed logged is just to differentiate between those who inadvertently touched the inductive loop when almost stationary and those like yourself who just motored through.

The offence will be travelling not in accordance with a traffic signal.

OK, thanks for that. So I expect im looking at the usual fine and 3 points? Is there anyway I can avoid the points? (Opt to go on a course or something)

Just out of interest how accurate are the speeds they quote? I'm sure I wasnt doing anywhere near what they say huh.gif

Speed is usually accurate, but may be wrong (why, like radar Gatso, it takes two photo's, they have probably just quoted the inductive speed, not looked at the time elapse photo's that carefully).
