Retail Park in Leeds. Our friends at Excel issued a PCN for code 81 - restricted area.
Absolutely no restrictions.
Only two sites on whole of car park. Entrance and exit.

Image of sign attached.
Course of action??
Ignore them??

Any comments on the sign as it doesn't seem too official.

Excel are well known here.

Ignore and file away in a drawer. It is just an unenforceable piece of trash. DO NOT PAY!

I just see this type of notice and think.............free parking.............! also lets keep the posties in a job delivering junk clap trap from them. its a win win situation

Its not a 'PCN' - a PCN is a bona fide Council issued thing. What you have is an uneneforceable invoice.

Does it say PCN on thepaper ? by all means scan andpost that - just wash your reg and car details and timeof day from it forst. the PPCs come here often and read the threads.

read the PPC FAQ that hangs of the sticky at the top of this forum. plus some of the many posts about PPCS here.

Once you have your head around this scam and how it works and how it fails tell ALL your friends about this scam and how to handle it.

do NOT worry.
do NOT pay them
do NOT contact them in any way (or you get on the hooked fish list and they pester you more)
get on with your life.

keep all the letters you have (and those you will get) in a drawer.
to make it go away thats it.

to bite back (much more fun)
for each and every letter and for any invoice that was attached to a vehicle make a photocopy and send the copy plus a letter of complaint to local Trading Standards.


Excel's website talks a tough game - IIRC they even say they always take unpaid 'tickets' to the Court stage. Strange we have no case of that happening recorded on here... smile.gif
Excel is a big company and rakes in a lot of cash (ask Watchdog smile.gif ) so they have to come near the top of the list of transgressing PPCs who should be complained about IMV.

joke. looks like a clear attempt to be a 'look-a-like' to a council issued PCN to me.

am not a lawyer but the Fraud Act 2006 just came to mind..

2 Fraud by false representation
(1) A person is in breach of this section if he—
(a) dishonestly makes a false representation, and
(b) intends, by making the representation—
B
2 Fraud Act 2006 (c. 35)
(i) to make a gain for himself or another, or
(ii) to cause loss to another or to expose another to a risk of loss.
(2) A representation is false if—
(a) it is untrue or misleading, and
(b) the person making it knows that it is, or might be, untrue or misleading.
(3) “Representation” means any representation as to fact or law, including a
representation as to the state of mind of—
(a) the person making the representation, or
(b) any other person.
(4) A representation may be express or implied.
(5) For the purposes of this section a representation may be regarded as made if it
(or anything implying it) is submitted in any form to any system or device
designed to receive, convey or respond to communications (with or without
human intervention).

Cheers for scanning it in, but it's an unenforceable invoice, as well you know.

Have fun opening threatening letters until they go away in 6 or 12 months!

Thing is,
there is no restricted area. Seems the jobsworth was issuing tickets in the likely hope most will pay.

What about mis spellings on details written down too. They make a difference??

The thing could be spelled perfectly, it remains unenforceable.

Not sure it's close enough to a council PCN for the Fraud Act to bite.

the wording is pretty much 'cloned' in key phrases. layout as well..
