Ladies & gents any advice appreciated
Last August I was stopped in the borders for breaking a 30 limit. I had my cruise control on at 30 as I do most of the time to avoid even straying over in built up areas
SHock of shocks it was two "Black Rats", white caps and all, who were very pleasant and professional, but insisting that their MuniQuip handheld radar clocked me at 43. I explained that I disagreed, in the politest terms, but got a ticket anyway.
I refused to pay this and have been summoned first to an intermediate diet (Scotland) then trial in April.
Verbal NIP given at side of road. Two corroborating abeit very short 2 sentence witness statements from plod.
Looks like I am snookered, but I refuse to accept points for something I was not doing.
There were two vehicles passing at the time, and plod zapped me from opposite side of road. They claimed at the time there were no cars there which I disagreed with.
ALso, I was on handsfree at the time when pulled, as they would recall. I remember a tale years ago that a car with loud speakers in action (mine was up full blast at the time) can give old fashioned radar a vastly increased reading.
This is honestly not a "looking for loopholes" exercise, but I cannot afford the £2000 I was quoted from a specialist lawyer so any advice greatfully received.

Be pragmatic about this. You have two police officers making statements, backed up by a laser measuring device that as of now is still considered to be accurate by the court. As you say a lawyer will cost a lot of money, and you won't get your (probably fairly substantial) costs back from the Scottish court even if you do win. So If I were you I would ring your insurance company and find out how much those three points are going to cost you before you decide.

Thats the thing...its not laser its an old fashioned radar gun they have used. That and I'm 100% positive I was not speeding. When clocked once before by a scamera van using LTI 2020, I thought about fighting but ultimately took the points as I could not be 100% certain I wasn't speeding.

There are a variety of other issues too......no correspondence from local PF for 6 weeks, no times of offences on there, and so on.....but main one by far for me is I seem to be pushed into taking the rap for something thats grossly unfair

Sadly it does not look good. The device is only to corroborate the officers opinion that you were driving at excessive speed, the officer provides the primary evidence. So you are left with.

Officer "he was speeding honest"
You "no I wasn't"

Who do you think will win?

I will fight regardless though. Cannot for the life of me work out (a) how/why they have me at 43 when I wasnt, (b) how you form a prior opinion where this alledgedly took place, been back 3 times to investigate/confirm and not possible, and © simply to push against blatant exploitation. What f*cks me off more than anything is that I strongly support low limits in built up areas, and policing them too, as you dont really ever need to go more than 30 in a BUA. Hence why I religiously stick to the limit, and use Cruise if I have to on longer stretches.
It would have only been a 3 pointer and I'm not at risk of a ban, or even close at 3 points, so this is purely a matter of principle. Sticking up for whats right

That said it will be interesting to see how I get on !!
