  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. COULD ANYONE TELL ME THE BEST WAY TO DEAL WITH THIS. THE REPLY IS ON THE BACK OF THE NIP.

I HAD A NIP FROM SURREY POLICE A COUPLE OF YEARS AGO AND WITH GREAT HELP FROM THIS FORUM I MANAGED TO AVOID PROSECUTION.
THIS SEEMS LIKE A DIFFERENT FORM, SHOULD I SEND THE LETTER THAT I WAS ADVISED ON THE LAST ONE STATING THAT I WAS THE DRIVER AND QUOTING
CASES OR WOULD IT BE DIFFERENT NOW.

Is it still the same whereas if you avoid filling in the NIP but send a letter stating you are driver and then do not answer anything else it is likely you will not be prosecuted.
I tried to find the letter it is suggested to send on here but couldn't find it.

No not quite

they have tightend up considerably in the last 12 months

theres loads of replys to similar q on here from people with far greater typing speed than me

However

You now have to name the driver or its six points

you can still send a letter if you want but you have to sign it and they will still charge you any way

there are other avenues Id start of asking for both photies of you on the grid painted on the road they dont have to send these but may if your lucky or pay a fee.

Just to be clear, do you accept you were driving at the time?

You cant use the 'Pace witness statement' I think you used last time...

I always advocate
1/ Writing and ask for "photo's to help ID the driver", it may highlight a problem (especailly with Gatso were the time distance calc can often be performed), at worst you get a souvenir (don't ask for evidence)
2/ Reply giving all the info they want in a letter (inc ref numbers) so they can't use image recognition software on your form and have to work for a living!
