I am trying to build a library of all the PePiPoo cases that have had happy endings, be it written confirmation or timed out.
Can all users post the link to their (or any other cases they know about) threads so a database can be made up. Once I have a list I will edit this post and update it as and when required.
Not that we get them that often, but when the trolls appear on the site and start having a go, it would be nice to point them in the direction of people who have "had a go" and came out unscathed.
Cheers.

five years ago, whilst passing through a very small hamlet (40 mph) in Yorkshire. I was stopped by two police officers, one with a hand held radar gun, which showed, correctly, 57 mph..
The signage on entry to the hamlet, from a NSL, was missing on the left of the road, and obstructed by foliage on the right. I took photo's etc.
At pre trial review in Barnsley, Utterly nieve as I was then!!! I showed the photo's. and the case collapsed. I asked for £64.00 costs, which were accepted. (I was thinking clearly, if not niaeve)
So, I am one up! ........ I hope on the 28 Oct to be Two up?

I have managed to time out 5 tickets fron Devon and Cornwall (3 for myself and 2 for friends).
At that time you could engage the scamera unit in correspondance and i honestly believe they never new about the 6 month rule

.
I'm currently helping another work colleague and he has just received a reply from Bedfordshire Police, the reply can be seen in the Bad Boyz and Girlz section.

Speeding Gatso 37 in a 30, Yorke compliant speeding only (pre Idris appeal). Convicted at Magistrates Court, they ruled that I had "confessed through Mrs Patch" as she had completed the form as my agent.
Appealed to Crown Court, appeal not contested at the 11th hour. Full expenses awarded, apart from travel costs in all personal cost was £350 but it was great fun
Many thanks to JJ for winning the case on my behalf.

Alleged 102mph in 70. Unsigned form sent back, pre-Idris, non-Yorke compliant.
Many bluff and bluster letters, eventually received summons for speeding only. Represented by JJ, case thrown out due to lack of evidence, S172 charge had timed out by the time it got to trial. Cambridgeshire Constabulary did admittedly cock-up by stating that no NIP had ever been returned, which was blatantly false.
The other case below was a friend's. Unsigned form to South Wales, many B&B letters, a couple of PePiPoo letters sent back, eventual written confirmation that no charges would be brought.

Herts Constabulary. Alleged 40 in 30 (GATSO camera). Paragraph 4 defence used, constabulary declined to release photograph (seems to be standard operating procedure in Herts from what I gather).
Result: Timeout.

My wife received 2 NIPS for motorway offences. Both were beyond the 14 day rule (by about 3 months) both were dropped after this was pointed out to the police.
My sister-in-law accidently named me as a driver of an alleged offence on the A48 near Camarthen (she honestly believed that the place mentioned in the NIP was in Cardiff). The police sent me a NIP so I decided to play bluff and bluster with them until the original offence timed out.
So I am won 3 lost 1 (lost my own case unfortunately

A colleage at previous employer, ~a year ago, was sent NIP - alledgedly too fast on M6 during roadworks - Wolverhampton > Coventry.
Encouraged by 'RD', another employee who 1st put me on to this site, he sent the NIP back, unsigned, via recorded delivery.
His unsigned NIP was returned, with a compliments slip, and the unsigned part highlighted - not via recorded delivery.
Months after I left the employer, he had still heard nothing, nearly a year after alledged incident.
Another employee was in the same boat, taking advice from RD who was taking advice from 'Pepipoo'. Don't know the outcome.
No written confirmation. Seems case has timed out.

Just remembered that I also got my mum off a speeding charge when I pointed out that they got the location wrong. The NIP alleged that she broke a 30mph speed limit on a road that is actually NSL.

I have put this elsewhere but I have been informed it may sound like a success.
I was caught at 108mph on the M4. Dry clear day.
Went to the Magistrates, explained how I could be sent anywhere in the world at the drop of a hat with the job that I do and that I need my license for the duties I would carry out. She explained that she will have to give me a disqualification but under the circumstances would give me the lowest possible within the guidelines which was 14 days. She threw in a 400 quid fine + costs but no points on my license.

FF,
See
Case withdrawn!
And thanks for your help and support too.
One other case a few years ago: overtook somebody on a country road who got the hump and reported overtaking in a dangerous place to the police. Charged with driving in a crazy way, or whatever. I had a number of witnesses prepared to state the contrary, and considered calling a policeman who overtook me in the same place another day as a witness. My solicitor contacted the CPS, saying 1 man against 3, and the matter was dropped.

Alledged 46 in a 30mph. Hertfordshire Constabulary
Went unsigned route (pre Idris).
NIP returned with request to sign.

however, Herts scameraship are refusing to close-out the case and confirm time-out.....so presumably this just stays on record...and next time i get stopped by the police i'll be bullied for a still-open speeding offence.

QUOTE (Talion)
ff dont forget all those who have had reduced points/fine I would call that a success also.
I have recently been informed by a friend that she was pulled over by a BiB for speeding and issued with a NIP. However, when she made it apparent that she'd fight it, they offered to give her the points with no fine

According to her, the reason they gave was because they were hidden from the view of traffic.
Why would they do this :? Can they do this
She intends to take the offer as she currently has a clean license.
I don't know the full details, so I'll try and get her to register and post in full.

This is what happened to me in court yesterday, i posted it in the members section first
Had a lucky result in Court today.
Brief outline of what happened;
Oct 11 last year i was stopped on the M5 between Taunton and Bridgwater for doing 98mph. The officer took me into the back of his car (i had no one with me to act as an independant witness) ran through what had happened, clocked me with hand held LTI 20-20 then did a follow check(?) where my average speed over 1.5 miles was 98mph.
He issued me with a verbal NIP to which i replied 'i do not understand the significance of those words and wish to exercise my legal right and refer to PACE the police and criminal evidence act'. He did nothing a told me to get in my car and carry on my journey.
3 months later i received my summons and on the S9 statement from the officer on the part where it says what reply did the defendant make he wrote none, lying bar steward.
After a phone call to Mika he said as i had had no independant witness in the back of the police car it was basically my word against the police officers and guess who the mags would believe?. My only option was to go for disclosure of the officers notebook.
After 5 PTR's and adjournments trying to get the notebook disclosed i received a copy of the notebook on the day i was stopped and there was no entry in it stating what i had said.
Had my trial today so on Monday i faxed the Court to change my plea to guilty, so i arrived in court today called into court i was asked to confirm my name and address, the clerk sat down the CPS bloke stood up was shuffling papers for a few seconds then said 'i'm afraid we seemed to have lost Mr. Bulletmagnets paperwork'. After a short conversation between the clerk and CPS bod the clerk turned around and said to Mags that the case against is dismissed.
Result.
I knew i was on a loser when i received the witness statement and the officer lied saying i made no reply, so i decided to give the CPS the runaround as much as i could. Thanks to Mika for the advice about trying to get disclosure of the officers notebook. Never give in and who knows you might get lucky like me.

Only just discovered this area. I guess I should add my own five time-outs. In (I think) chronological order:
One was an admitted inconclusive numberplate after a frank denial of the car being in the area (which it wasn't), one was a "failed to recognise the driver" after receiving the photo (this could have been a cloned plate as the front styling was subtlely different too). One was never put forward, despite being stopped, admitting the offence, when I was on the way to my father's death bed on Boxing Day (is there a God after all?), and two... Well, I plead the fifth, as I did at the time

Had a "fun" win recently.
Charge was speeding. Form sent back properly signed. Video evidence was pretty conclusive BUT
S9 statement said that S172 notice sent out but concluded "no reply has been received".
Prosecutor read out statement but not the last bit.
JJ: "Would you please read it all"
Prosecutor (nice girl with rapidly reddening face) reads final paragraph but says "That's obviously a mistake because......."
JJ: (leaping to feet) objects as witness statement contains warning about prosecution if statement false so Prosecutor can't give evidence.
Submission of no case to answer made on basis that no evidence that client was driver was upheld so case dismissed with order for costs.
Can't comment as to whether this was a just result but it does go to show that the S9 statements should be scrutinised very carefully.

S2softy, another sub-section (4). He had been named as the driver by his company; so, presumably, the CPS would have had to show that the information 'was in his power to give', or, that being 'Team Leader' made him the 'keeper'.

Hi everyone,
After much wrangling with Humberside CPS over confirmation of driver ( I was in Sainsburys about an hour before the alleged offence which was at least 2 hours if not longer drive away) & a side order of out of time NIP I was summonsed for speeding & 172.
Due to appear in court in Jan 2005, armed with erroneous statements from the CPS clerk, Mohindra & a statement from the police officer that he 'formed an opinion...' etc etc dated sometime in June 2004. (The alleged offence was in Dec 2003).
Today I have had a notice of discontinuance for both charges on grounds of there not being enough evidence to secure conviction.
Merry Christmas RSW!!!
I would like to extend my grateful thanks to all the guys here in Pepipoo whose forum has helped me to have the courage & knowledge to fight the scameraship. Whenever I started feeling down or wavered in the fight I visited the forum and there always something or someone there to bolster my flagging spirits. We received the following message today

:
“Dear PePiPoo,
You might remember I wrote to you last year about the NIP I received (details below). Well, I asked Robert Dobson to represent me, on your advice, and the other day he rang to tell me that Lincolnshire Police had dropped all the charges, a week before the court case!
What had happened was, I'd explained to them (via Robert) that as I was pregnant at the time of the alleged offence, my husband and I swapped over the driving very regularly because I got uncomfortable either driving or being a passenger for too long. This didn't seem to cut any ice, and they continued to say they were taking me to court. Shortly before the date of the court case, they sent copies of the photographs the speed camera took to Robert. He forwarded them to me, and I could clearly see a hand on the steering wheel in the photographs, and a glint of metal on that hand that I knew was a wedding ring. I then wrote back to them to say that if they enlarged the photo and enhanced it, I would definitely be able to identify the driver because my husband and I wear very different types of wedding ring. They wrote back to say that they would not do that, and so Robert pointed out to them that I had surely now done everything I could to show 'reasonable diligence' in identifying the driver, as I was under no obligation to furnish them with this detail about mine and my husband's rings.
Anyway, a long and bizarre story, but perhaps one that might be of interest to your website visitors, especially ones who wear different kinds of wedding rings from their spouses!
Thanks again for your help!
All the best,”
