Received a NIP for a lease vehicle about a month after the alleged offence of 35 in a 30 zone.
I asked to see the photographs and received an A4 sheet with three photographs measuring 60x30mm.
My vehicle is far from the camera, at the very end of the distance markings.
Even after enlarging the photographs on the pc, the quality is so bad that I can't determine the speed from the road markings. The Gatso readout says 35. But there are surface scratches and some of the lines are lost in shadow and poor resolution. I've no doubt the originals are good quality. By studying shadows on the road and those markings I can see, I calculated the speed to be 28, maximum 33mph.
Raising these points in a letter I received the response that the camera readout is the evidence and if I want to challenge the accuracy then I have to attend court. (100 miles away if it's their local court). Without good quality photographs I can't be sure. I feel like they're bullying me into accepting the points and fine.
I've just read the APCO Code of Practise and read the following:
9.4 Multiple Vehicles Radar speedmeters are designed to measure the speed of one vehicle at a time. Should there be more than one vehicle present in the radar field of view, it is possible for the device to detect two different signals, and alternately display different speeds in which case the check must be aborted.

There is a second vehicle almost alongside me in both photographs. Does this mean the Gatso reading is inadmissable?

I've read the "Read me first" again. Followed pretty much all the links but can't see any help there. The wizard wasn't working when
I first posted, kept getting 404 errors. I just tried it again and it works but see no way to send the result here except to copy/paste.
So here's the wizard content:

Reading the stories here I thought my case so flawed it would be simply resolved without effort.

I'm a bit of a plodder, not interested in being the first away or getting there fast so was surprised to get this NIP. And 29 years clean licence means either I don't speed or I've been very lucky. I couldn't honestly respond guilty or not so requested the photos. Three tiny little photos 3"x"2 were returned, they showed two cars side by side in both pics. (I thought that automatically made the pics inadmissible) and the quality of the pics was so bad that the white lines were not discernible, even after enhancing. Upon questioning this came the reply that the fact that a pic was taken was alone sufficient evidence. Not so straight forward I thought, so engaged a well known solicitor to act for me. Solicitor was confident and two adjournments later because the CPS hadn't supplied information, they were told they had to attend court and sent some documentation which was pretty much a duplication of what they had sent, including the bad pictures, and a revised witness statement correcting something he'd missed out in the original. So court date finally set, despite believing it would never get there, solicitor advises court costs likely to be £600 plus his charges, plus of course the cost to me to make a 200 mile round trip and take the day off work. OK for those that can afford, but hard times, I barely can afford to get to work this week. So, solicitor dis- engaged, letter to court saying I give up. I don't even know if I did it or not! No problem pleading guilty right back at the start if they'd sent good pictures. In summary. Justice is only for those that can afford. Innocent until proven guilty means nothing. Some of the police and CPS are no less than bullies misusing public funds to get thier own way. They destroyed any respect for the law that I had.
I hope they read this site!!

Oh they do read this site!

And unfortunately some of them will be celebrating what happened to you and shouting "Result!".

Every person has the right to contest the accusation against them, but "they" are working very hard to make sure that only those who either have deep pockets, lots of time and energy, luck, or specialist knowledge can possibly do it.

For what its worth, if your vehicle is at the very end of the check marks and there is another vehicle in view that is closer to the camera, its very likely that the speed reading is coming from the closer vehicle.
