Received a NIP for a lease vehicle about a month after the alleged offence of 35 in a 30 zone.
I asked to see the photographs and received an A4 sheet with three photographs measuring 60x30mm.
My vehicle is far from the camera, at the very end of the distance markings.
Even after enlarging the photographs on the pc, the quality is so bad that I can't determine the speed from the road markings. The Gatso readout says 35. But there are surface scratches and some of the lines are lost in shadow and poor resolution. I've no doubt the originals are good quality. By studying shadows on the road and those markings I can see, I calculated the speed to be 28, maximum 33mph.
Raising these points in a letter I received the response that the camera readout is the evidence and if I want to challenge the accuracy then I have to attend court. (100 miles away if it's their local court). Without good quality photographs I can't be sure. I feel like they're bullying me into accepting the points and fine.
I've just read the APCO Code of Practise and read the following:
9.4 Multiple Vehicles Radar speedmeters are designed to measure the speed of one vehicle at a time. Should there be more than one vehicle present in the radar field of view, it is possible for the device to detect two different signals, and alternately display different speeds in which case the check must be aborted.
There is a second vehicle almost alongside me in both photographs. Does this mean the Gatso reading is inadmissable?
