Please do not post personal details for obvious reasons - I was sticking to the speed limit of 30mph on the dual carriage way section, a porsche came right up behind me and was in my opinion dangerously close. I started to pull in and simultaneously he started to undertake me, my reaction was to accelerate quickly to a safe distance then slow down to the limit. I was involved in an incident 1 year ago where a vehicle wrote my car off because he changed lanes without looking, consequently I am very uncomfortable in similar situations. I also had my daughter in the car at the time.

Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Just goes to show the folly of speeding up unfourtunatly, as you seem to realise your reasons will cut no ice with the scammers..

Its worth asking for photo's to ID the driver, if two cars are in shot they shouldn't prosecute, if nothing else you get a souvenir for your money...

For that speed its unlikley you will be offered a fixed penalty so it will be off to court, once you have the photographic evidence then it can be checked.

I know the scammers pretty well in that area. They are using illegal Gatsos in vans, the signs are appalling in the Newcastle area too and I know of at least three stretches which do not show the correct 30 sign on either side of the road which invalidates any summons. Take a ride along the route. Mark out all signs you see and whether they are on both sides of the road. The Central Motorway section has several turn offs which are poorly marked so chase up on this. Find out which device snapped you. Ask for photos to help identify the driver and get back to me via PM
