My daughter picked up another PCN in a council car park. Seems she had to put in £9.00 for over 3 hours parking. She said she put in £9.00 and placed the ticket on windscreen but the ticket only stated £8.90.

Its Epping Forest District Council and I know that London PATAS have accepted that "you are therefore required to pay..." allows an appeal but am not sure if this is accepted by out of London parking adjudicators.

This is the wording of the PCN. I will write an informal appeal on grounds that corrcet payment was made and that 10p short is not a reason why we should have to pay a penalty of £30 or £60.

also says queries about the penaly charge notice cannot be dealt with over the telephone and should be made in writing to the parking office address above

If you require any further information aboutr this penalty charge notice or, to make a payment in person, you may visit the Parking Office, Burton Road Depot, Burton Road, Loughton IG10 3QS which is open between 9.00am and 5.30pmMonday to Friday.

If payment is not paid within 28 days, the registered keeper or the person who EFDC belives to be the owner of the vehicle may recieved a Notice to Owner asking for payment. That Notice will also describe how the owner may make formal representations objecting to the issue of this penalty charge notice.

You are right there ! NPAS do not accept PATAS decisions even though the ticket wording differs to the one given in the RTA 1991 sec66 NPAS still think they are correct, the specimen ticket that NPAS have is worded incorrectly so the councils just follow suit, you could try to appeal it but dont hold your breath, sorry to be the bearer of negativity. sad.gif

Neil Herron raised this issue about Hull's tickets - http://neilherron.blogspot.com/2007/08/had...et-in-hull.html - the problem is, that the NPAS website sample ticket uses that phrase, so they are bound to reject the appeal - however we know it's wrong, it might be that the judicial review has been heard?

Any views on the 28 days issue as mentioned in the PCN (please see above). Is this wording correct.

Front of ticket states with in 28 days of date of issue back states (If payment is not paid within 28 days, the registered keeper or the person who EFDC belives to be the owner of the vehicle may recieved a Notice to Owner asking for payment. JR not been heard yet, its gone to adjournment because of large ammount of evidence Niel has lodged, Id seriously like to go to JR with my said ticket but it costs money and lots of it and I aint got legal cover on any of my insurance policies so its a non starter for me.

RTA 1991 Section 66(3) states “Before the end of the period of 28 day beginning with the date of notice”.
