  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Hello forum,

As a footnote to the above, after receiving the NIP, I returned it, uncompleted, with an accompanying letter stating the Mawdesley defense. This was completed in time and then I subsequently received a "Conditional offer of a fixed penalty".

I would greatly appreciate any advice from the forum regarding my potential options.

I presume you mean you sent back what is known as the PACE witness statement? If not to get any advice you will have to be clearer.

Thanks for posting. I believe that we are talking about the same thing. The letter that I sent to accompany the uncompleted NIP was a pre-structured letter. It comfirmed receipt of the NIP, my name, address, DoB and driver number. It then stated that I had not received a caution under 10.1 of PACE and thus the statement could not be used in any proceedings.

Incidentally, I noticed that when they sent me the conditional offer, the hyphen was ommitted in the middle of my surname. Technically, I guess this is a mis-spelling.

What are your thoughts?

The missing hyphen is irrelevant on the CoFP as you either accept or ignore it....

The PACE defence will not help you until we get a ruling from the Burgess-James appeal which we still don't have a date for AFAIK.

Ignore the CoFP if you want to fight on and you will have to mount a technical defence.

Is there any merit in returning the CoFP uncompleted with another copy of the PACE statement as a measure to reiterate my position?
