I was flashed at 55mph in a 40mph limit just after a corner. I braked but was still flashed.

I used PACE form hoping it would time out.

I have recently received a Court Summons. This was received on 31st Aug or 1st Sept. The A4 brown envelope is post marked 29-08-07. 44p postage paid printed. Address printed on front is PO BOX 510 SW1v 2JP.

The cover letter is headed with Metropolitan Central Operations. Traffic Criminal Justice OCU. It is stamped next to signature [officer in charge] with the date "28 Aug 2007"

A certificate has been produced in accordance with section 20 of the Road Traffic Offenders Act 1988: this and a copy of the photographic evidence are enclosed. The certificate and the photographs will be tendered in evidence before the magistrates unless you are intending to plead not guilty, in which case the matter will be adjourned to a later date.


If you wish to plead not guilty you should inform the Magistrates court within seven days of receiving this notice by writing to the address on the summons. If you do not do so within seven days of receiving this notice you may lose your right to prevent the certificate and photographs being tendered in eveidence.

I have no grounds for believing that the information recorded is inaccurate.

The vehicles speed was recorded as 55 miles per hour

The speed limit on this section of road is 40 miles per hour.

Is there an argument that as it was received after 6 calender months it is no longer valid.

What is the 'Date of Information / Complaint' ? It will be printed on the summons.

If this is within 6 calendar months of the alleged offence then proceedings were commenced within time.

Thanks for replying.

At the head of the summons it is dated as 16.08.07

On the statement of facts page on the summons at the bottom it is dated 20.08.07


Can not see on the summons of when the docment was printed.

The link from bailii is very informative. Will read and digest.

Offence was on 28-02-07 and summons received on 31-08-07 [post-marked 29-08-07 on envelope]

In that case it sounds like they are comfortably in the 6 months I think with the necesary information (the statements of facts contains all the info needed for a summons in that its name/offence/place and relevant act)

You will want to carry out the secondary speed check using the time/distance from the Gatso photo's.
