Hi everyone, Thsi is my first post here, so I apologise if its in the wrong place, and if it is can a Mod please move it Thanks,

Anyway the Story,

Car Crash Line 'CCL' provide cars following accidents and claim their charges from the 3rd Party

In bried the story is as follows.

Had car crash (claim ongoing)
Was provide car by CCL (who claim from OP insurance)
Friday pm - car recieved
Friday pm - problems with car straight away
Saturday am - car changed
I recieved and agreement to sign, which I didn't due to the fact of the service provided.
Sunday drve 10 miles
Monday am - wife drove to work
Monday pm - car brokedown - used 1/4 tank over 10 mile while kangeroo-ing
Monday evening left message to call me
Tuesday am told them to collect car and not bother replacing - as they had failed to provide road worthy vehicles twice now
A week later got claim letter from them, to log accident details etc so they could claim - called and pointed out that they had not provided a service and therefore no agreement now
A week later
I then recieved another copy and a request to sign the agreement again.
I spoke to them and told them that i didnt think they had provided a service and therefore would not sign, noboy got back to me.

Nothing for a month

Then get letter from them stating OPs insurance disputing liabilty.
I call them again stating the same

Then i got a letter from their claims dept asking me to give them accident details, so they can claim from the 3rd Party.
I phoned them up and told them the same, they said that i had done so many miles and that they need to claim that.

I then sent the following letter to them:

Dear xxxxx

Before I can supply any further details regarding the incident, I need you to supply me with the following information
  • A copy of the signed Hire agreement,
  • Proof of the alleged mileage,
  • Breakdown of costs to which you are claiming from the 3rd party.
Once I am in possession of these documents, I will check that everything is correct and I that agree with your cost breakdown.
I will then forward the further details that you requested.

Well i recieved the response yesterday and it amazed me.
They had included 2 signed agreements by myself (remember i still have the unsigned copies at home).
What they have done is used the electronic signature, for when i signed for the delivery of the car, and put it onto a agreement.
Their agreements also do not tally up with my originals, in that the first car has a delivery charge added as well on my copy. On their fabricated docs, it is on the second car.

OK then, I think I should be speaking to Trading Standards at first, but who else? Any Insurance bodies ie I think this is insurance fraud.

Any Thoughts or Ideas

Speak to your insurance company and to the OP's insurance company (you may not be able to do this direct, it may have to go through your insurance company).

Ask the insurance company if you should go to the police and report it as an attempt to get money by deception (you probably should) or if they want to do that themselves.

If you believe that either of the vehicles you had was legally unroadworthy, i.e. not safe to be on the road, as opposed to simply incapable of getting you from A to B without breaking down, then you should phone the local police and report the reg numbers so they can be inspected and got off of the roads.

Besides the problems with the crap car you appear to have clear evidence of forgery/criminal activity.
Do not let go of that evidence !
this is a fightback forum - pursue the buggers. How many others have been kippered like this, and how many will be done in future ?
The ABI does not regulate so would not go there.
Police and or the FSA probably.
FSA's aims are:-
1) Promoting efficient orderly and fair markets;
2) Helping retail consumers achieve a fair deal; and
3) Improving our business capability and effectiveness

how effective the FSA is another question...
the police kick back bank fraud cases to the Banks instead of investigating themsleves so who knows how they would pursue your case ?

there are fraud specialist solictors who may give a free 30 mins over the phone type thing.

May be worth researching the company a bit - this could be their standard MO

Quite a serious claim you have against them here. Are you sure when you signed for the hire vehicle that you did not sign any vehicle hire agreements or are you certain that you only signed an inspection sheet. I work in a similar company (not CCL) and we always give clients a copy of their hire agreements and ask them to sign another copy.

Also may be worth enquiring how far their branch is from your home as this will probably equate to most of their miles. According to their website they only have 13 branches across the UK.

Also it is worth noting that credit hire is regulated by the ABI and their are strict requirments for getting the hire costs back.

Speak to your own insurers about it - they will have a fraud team.

Do you also have details of the third party insurers? It is very important to warn them about this - put them on notice so that don't make any payments. If you don't, your insurers will have their details.

I investigate insurance fraud, so will take a look when I'm in the office tomorrow.

Looks interesting.

I know a company by this name, but I think it's a different company altogether. I'll see what I've got, if anything.

MY car was being repaired and the CCL car was delivered to the bodyshop.
I only signed for the condition of the car, no scratches etc (as you do with a normal hire)
I then received the agreement in the post the following day for me to sign and send back.

I have their details as i have a copy of the Bill CCL are pursuing them for.
They are disputing liabilty with CCLs claim anyway, and I wont give CCL any further detail due to the fact I dont believe thay provided a service they could charge for.

I believe credit hire comes under the FSA (Financial Services Authority) mortgage and general insurance regulation.

To the OP - when you originally gave your signature, was it on a screen (maybe a palm pilot, or a tablet in their office?) or did you just sign in pen and ink on the vehicle condition form?

If I were you, I would cease all dealings with CCL and instruct your insurers to appoint a specialist firm of solicitors (as opposed to claims management people).
