Subject: Important Update

As previously mentioned on Monday 21st July I sent letter to Devon
and Cornwall Scamera unit asking where in law etc mentioning Pickford
and offered to comply with any legal request but added that I would
not expect them to make any unlawful request or to mention DPP-v-
Broomfield as it doesn't apply and they MUST be aware of that. Today
I received a letter dated 23 July with my 3rd NIP. Please bear in
mind that the allegation is that my company car was filmed on a dual
carriageway at 12:48 at 103 mph. YES 103 mph!!!!!
Their reply:- " Further to your correspondence relating to the NOIP
sent to you, this is a statutory document and must be completed and
the information forwarded to this office within the specified time.
Should this information remain outstanding, the matter will be
referred to the courts after the permitted 28 day period.
I therfore enclose a further NOIP for your completion and return. A
FIXED PENALTY WOULD BE APPROPRIATE IN THIS CASE, BUT UNLESS THE FORM
IS COMPLETED AND SIGNED, I AM UNABLE TO OFFER YOU A FIXED PENALTY."
Obviously the capitals are mine - but anyone else heard of a fixed
penalty being offered for this sort of alleged speed. Certainly I was
advised that if it had been me and I was to plead guilty even with
mitigation, ex Police driver, no accidents or convictions etc, I
would still be looking at a Magistrates hearing a minimum 14 day ban
and around a £500 fine !!!
No reference made to where in law signature required of course!
I really do not want to back down and feel that I must have them
rattled but getting grief from the wife to back down gracefully and
bite their hands off at £60 and 3 points - but that means letting
them win.
Any comments greatfully received - and no I am not in the Masons!!

Hi Jeffery,

It may be a ‘standard reply’. Don’t forget that all these unsigned forms are causing an awful lot of stress and extra work. rolleyes.gif

In my opinion, it may be considered as a “mistake” once they are in receipt of the signed section 172 notice, and a court summons could well follow soon after. icon_redface.gif

My ex-boss got videoed, pulled and summonsed for 120mph on the M60, 4 points, £400, no ban.
