Hey up Hissin Sid.
Maybe if you opened up a topic specially for your case it might help.
If you complete the NIP Wizard with all the details needed we can all get stuck in and advise from there.
Hissin Sid
Hi All, here are the sorry details, all help greatly appreciated.........

NIP Details and Circumstances
What is the name of the Constabulary? - Strathclyde
Date of the offence: - May 2007
Date of the NIP: - 6 days after the offence
Date you received the NIP: - 7 days after the offence
Location of offence (exact location as it appears on the NIP: important): - Springburn Rd, Glasgow near to Huntershill Street
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 3
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - A motorcycle owned by myself was photographed by a fixed camera (from behind) at an alleged speed of 43mph in a 30 limit.

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - Scotland

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:

Help please anyone ?????
Monster 900
If you were the rider I would do as the NIP Wizard suggests.
Rev-head
wait for the 26th day return filled in by someone else .i.e partner unsigned recorded delivery (remember and keep the slip to prove you sent it) then wait it out and hopefully you will join the many people that have timed out
Hissin Sid
Should I use Special delivery or recorded delivery ?
Also, does anyone know what to do when you get local plod on the doorstep to try & get you to sign the NIP ?, I have read that this is a strong possibility but not much info on the technicalities of it.

Yes: (a) Special delivery as it is the only one to guarantee next day delivery and provide proof of delivery. If you send recorded delivery you need to send earlier in case of failure.

I understand if the plod comes round it's best for them not to find you at home. If they do find you, ask them if you are suspected of having committed an offence, they should say yes, you then ask to be cautioned after which you say nothing.
Hissin Sid
But refuse to sign the NIP ?.........is that right ?

ask them if you are suspected of having committed an offence, they should say yes, you then ask to be cautioned after which you say nothing.

In Scotland, there is no requirement for a caution before being required to provide statutorily required information (which is what S172 is).
Hissin Sid
Thanks for your post Jeffrey, so if the driver info has already been supplied on the returned nip & plod are only requiring a signature, how would you deal with them ?, assuming they arrive whilst you are in the garden etc. Am I right to assume that they can`t harass you at work ?.

thanks for your help........sssssid
Hissin Sid
Does anyone know at what point you can ask to see the photograph from the fixed camera ?
Hissin Sid
Having ignored the first NIP (6 weeks since 1st notification) I have now received another form asking me to name the rider of the motorcycle.

Do I a). Return the form unsigned (filled in by wife).
b). Ask for a copy of photo to help in recognition of rider.
c). Write back saying that I never received the NIP in the 1st place, there is no proof that I received it as it was sent 1st class post.

I would be grateful of some sound advice now...........thanks Sid

if you want to fight maybe.

you have already said you know who the rider was so why ?

If you want to end up in prison as well as having points and fine it would be a good start.
Hissin Sid
Hi Crystal, thanks for replying.

As this seems to be the best route to go along in Scotland, How long should I wait before returning the 2nd request unsigned, is it safe to wait the 26 days & return by special post ?
Hissin Sid
advice anyone ?
crystal
Hi

Leave until as late as you can and use a signed for next day delivery

Crystal
Hissin Sid
Hi all,
well I returned the 2nd request for riders name unsigned by wife (also undated) & have today received 1st COFP. I now have 28 days to pay & submit licence or "be reported to the PF for being a bad boy", should I just ignore this one ?. Do they normally send another before they get tough ?.
Has anyone got any idea what Strathclydes normal procedure is ?

Thanks in advance.
Hissin Sid
Hi all,
Has anyone got any experience of this situation in Strathclyde ?.
What happens when the COFP is not returned ?, do they issue another or is it court time ?
thanks Sid dry.gif
Hissin Sid
Hi All,
thats 6 months now since alleged offence & almost 4 months since I ignored the COFP, hopefully it is safe to come out from behind the sofa. I just want to thank all you good people on this forum for your sound advice & encouragement to fight the scammers, it looks like it has all paid off.
Thanks again Hissin Sid
