Full Version: NIP Completed, "offer" received - can I still fight?

Already filled in the NIP before I found the web site and had the offer of 3 points and £60 fine for a speeding office on a motorbike (37 in 30). Already asked for the picture, which I received showing the helmet and upper body of rider from the front - but nothing else, including no number plate. The NIP stated the reg number, but the photo does not show it.

Is it worth fighting on a technicality?

But having signed the NIP and already sent it in, does that amount to a confession? As I am at the stage of having the "offer", does that not mean it is too late? I have not yet been cautioned, but have I "admitted" guilt by signing the form?

The PACE witness statement specifically says NOT to sign the NIP or in fact complete any of it!

Hey mike! I'm quite new here but do as the man says.Fill in the forms and post it !!

You wont get sensible help without following the proper route which extracts necessary details !!

Yes there is no point trying to complicate matters by sending them the PACE Witness Statement.

However, you still need to fill in both parts of the NIP Wizard because we need to know all the facts about your specific case.

There are ways you can fight this if you are up for it. There are anomalies with different NIP's, so knowing the area and force that issued it will help. It looks like you were done by the amazingly inaccurate LTI 20-20, which there is a feast of information about on this forum.

But to give you the best advice you need to tell us all the details of what happened via the NIP wizard.

Date you received the NIP: - 21 days after the offence. (I opened it on this date - I had been away on holiday and it was waiting for me in the post when I returned)

Location of offence (exact location as it appears on the NIP: important): - A30, London Road, Hook

Was the NIP addressed to you? - Yes

Was the NIP sent by first class post, second class or recorded delivery? - Not known

If your are not the Registered Keeper, what is your relationship to the vehicle? -

How many current points do you have? - 6

Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons -

Coming off a roundabout on motorcycle, accelerating away from following traffic. Saw police van parked next to hedge on my side of road - van not visible from roundabout as it was around a slight bend. No obvious sign of camera or personnel so ASSUME picture was taken through dark glass panel in rear of van. Started deceleration as soon as I saw van but was logged as 37 mph in 30 zone. I have received picture which is taken from forward prospective with no number plate visible. Some foliage from the hedge is visible in the right hand side of the picture, there is no visable traffic in my lane behind me but 2 cars in the other lane heading away. Clear, dry conditions in daylight. Printed on the picture below my speed, 037mph, is the figure 0089.9m
