Full Version: Can the police issue anything other than 3 points £60 fixed penalty?

Hi guys,

Simple question i can't find an answer for.

If the speeding offence is deemed to warrant more punishment than the standard 3 points, £60 are the police able to issue fixed penalty notices for 4 points, 5 points, etc with varying fines attached or does anything other than 3 points £60 have to be decided in court?

Ok, so to clarify anything deemed worth 4 points will mean a courts summons upon returning the NIP signed?

The guidelines for FPNs/COFPs are
30 limit - up to 49
40 limit - up to 65
50 limit - up to 75
60 limit - up to 85
70 limit - up to 95

At the higher ends of these scales, you'd get more than 3 points if convicted by a court, but the police would generally issue a fixed penalty (which is currently fixed at £60 and 3 points for speeding - although this is due to change when the relevant section of the Road Safety Act 2006 comes into force).

How does the relevant section of the Road Safety Act 2006 apply?

so if you are doing more then 30, you might as well do 49 as you get the same penalty as when you do 36. Does not make a lot of sense.

i couldn't agree more with you!! no bloody sense!

the whole system is bollox - in the states (some parts) you get a fixed penalty up to a certain limit depending on your speed - so 36 in a 30 would attract a smaller fine than 49 in a 30 - more logical - not let's fuck everyone with the same fine regardless of speed

think about it - if you get caught doing 35 in a 30 that's a £60 fine and 3 points on your licence (25% of licence gone for 3 years) which means you also have to tell your insurance that you did 5mph over the limit for 5 years and pay a higher premium - how bloody pathetic!

talk about OTT - it's just the sort of complete pile of shit you'd expect from this stupid government/country!

Neither does someone doing 50 in a 30 on an A-road dual carriage way, during the day, with no pedestrains around, in the dry, trying to avoid someone whos pulled away too slowly and nearly caused a pile up - recieving a summons

yet someone doing 49 in a 30 on a b-road in a house estate in the dusk, whilst wet around a bend with double parked cars on either side of the road and kids playing in the street -recieving a fixed penalty notice.

Safety cannot be measured in mph, and should not be, a lot of 30mph limits should be abolished and replaced instead with common sense, a lot should be made 20 or 10! Either way we all know speed cameras do not work for what they were intended for.

Speed cameras do work for what they were intended for which is to raise revenue. They have f**k all to do with road safety.
