Im helping out a friend of mine who has had a NIP for allegedly running a red light at 12 MPH. Told him to send in the PACE as described and has had a reply stating that a caution is not required for section 172 and also that Funke v France was a case concerning a tax evasion. No doubt a bluff and bluster letter I take it. Will scan in the letters sent back removing all personal details

He guessed GMP as most scammers now have there stock letter to reply to PACE (although some still use there stock no satisfactory reply letter), they are all different in various ways and GMP use that particular line on FvF. The original prosecution reasoning is not relevant to the core findings in FvF, but its pointless arguing that with them now! Just file and ignore!
