Full Version: NIP for a vehicle that belongs to my company

We as a Company have recieved an NIP for a mobile camera 51 in a 40.
I have asked for the pictures and they are rear facing.
Is it worth saying we dont know who was driving??
This vehicle has no fixed name against it.

Hi,

you should not lie as this can result in a prison sentance.

You should name the driver who will get there own NIP and they can come here and do the NIP wizard.

If your company does not reply at all it will be fined for failure to name the driver (S172)

And what fine does the Company get is it less than the fixed penalty ??
Surely there are no points to be given so better off doing that ?? blink.gif

You are treading on dangerous ground.The company could face a very stiff penalty and could even be found to be committing perjury.
We do not condone lying on this forum.

Generally speaking, the fine will be higher for a company than the fixed penalty amount (circa £4-500 I would have thought). This is means tested and the general consensus is that a company will be fined more as a higher fine will be needed to have an impact. However, as you have correctly stated, they cannot impose any points on anyone's license this way.

Whilst an inidividual can defend a S172 charge with good preparation and the truth on their side, this is more difficult to do for a company. The beaks always tend to think that the company should have a record of who was driving its vehicles at any given time. Unless you can show some persuasive reasoning why this is not reasonable, you will have a problem with the company defending a S172 charge.
