In March of this year I was the victim of an attempted Crash For Cash scam. The driver in front made several attempts to collide with my vehicle and in the end slammed on all his brakes without warning or reason. Luckily I managed to stop before actually hitting him.

On cue his ‘witness’ appeared and immediately said he saw me crash into the car in front. I stated this was not true and said I was dialling 999 as I considered the driver’s actions as attempted GBH. I proceeded to do so. As an accident hadn’t actually taken place the police weren’t interested in attending, gave me an incident number and left it at that.

The driver asked me for my details, as an accident had not occurred, I refused and drove off.

Seven days later I received an NIP for careless driving.

Three weeks ago I received a summons to answer the following charges:

1. Driving without due care and attention
2. Failing to inform the police of an accident
3. Leaving the scene of an accident without giving my details to the other driver
4. Driving without insurance.

I faxed a letter to the CPS pointing out that they had failed to send me an NIP within the fourteen days required by the Road Traffic Offenders Act 1988 for charges 2,3 & 4.

I also pointed out that on charge 1 there was no case to answer as the case had not been investigated. I had not been interviewed and my passenger had not been interviewed. This meant the prosecution had not even ascertained who was driving my vehicle.

I have just got off the phone to the CPS and they have agreed to drop all charges!

I urge anyone involved in a Crash for Cash scam to immediately phone 999 as the driver in deliberately causing an accident is guilty of attempted GBH. You will find the aggrieved driver soon vanishes! When you do this remember not to clear your phones memory as that will clearly show the time and date you contacted the police.

Typical of the police that they persued you rather than the real perpetrators.
Are you going to let it lie there or try and get the other party charged?

As a hard working law abiding bloke I haven't got time to pursue criminals. It's a pity there is not some force or organisation that could do the chasing for us if we paid them enough money.

Oh wait there is - its called the Police!

Without wishing to be accused of pouring cold water etc but you might just want to get a letter from the CPS confirming what they intend doing and also write to the Court. You don't want to find that your non-appearance results in the sort of cock-up the CPS are renowned for and that they do actually proceed. If you hear nothing then you might just want to get yourself along to the Court - just in case.

That was the first thing that crossed my mind. After speaking to the CPS they agreed to let me have the decision in writing, which they did.

The last paragraph invited me to make an application for costs if I had suffered any expense!

take that up

ask for something very reasonable like 20 just to make a point

Update on the crash for cash scam.

Yestereday I received a letter from a firm of solicitors saying they are suing me for injuries suffered by their client in the above accident, which of course didn't actually happen.

I replied thanking the solicitors for their letter adding that previously I didn't have the name of their client and that prevented me from reporting the matter to the Insurance Fraud Bureau. However thanks to their letter I now have that information and am proceeding with my complaint.

If anyone is the victim of a similar scam I urge them to report the incident to the Bureau. They can be reached on 0800 328 2550 or email to info@insurancefraudbureau.org

They also have a website which makes interesting reading.

oyster,

I feel very strongly, you should write yet again to the police.

If you have written , and they therefore have a file, this can only be seen as something worse than blackmail. If u havent written , u should have them on board as these guys are determined.. U would of thought they would go away wouldnt you ? .

I believe it is really a very serious matter... something u should take a great deal of care over dealing with.

in theory , u may need to inform your insurance ocompany, in case these silly buggers carry on and decide to go to court. Better people than me will comment about this action as it may affect your no claims etc .

This is awful, the thought that people can do this is horrifying and even worse that the police refuse to investigate. You work hard, you buy a nice car and some b*stard comes and smashes it up and then sues you. The police aren't interested because they are too busy chasing people who are doing 10MPH over the limit in a 50 and then they go to town and you can't shake them off.

I agree with taking this further with the police and asking them to investigate this alleged crime, it's their duty if they get a complaint isn't it?
