In March of this year I was the victim of an attempted Crash For Cash scam. The driver in front made several attempts to collide with my vehicle and in the end slammed on all his brakes without warning or reason. Luckily I managed to stop before actually hitting him.
On cue his ‘witness’ appeared and immediately said he saw me crash into the car in front. I stated this was not true and said I was dialling 999 as I considered the driver’s actions as attempted GBH. I proceeded to do so. As an accident hadn’t actually taken place the police weren’t interested in attending, gave me an incident number and left it at that.
The driver asked me for my details, as an accident had not occurred, I refused and drove off.
Seven days later I received an NIP for careless driving.
Three weeks ago I received a summons to answer the following charges:
1. Driving without due care and attention
2. Failing to inform the police of an accident
3. Leaving the scene of an accident without giving my details to the other driver
4. Driving without insurance.
I faxed a letter to the CPS pointing out that they had failed to send me an NIP within the fourteen days required by the Road Traffic Offenders Act 1988 for charges 2,3 & 4.
I also pointed out that on charge 1 there was no case to answer as the case had not been investigated. I had not been interviewed and my passenger had not been interviewed. This meant the prosecution had not even ascertained who was driving my vehicle.
I have just got off the phone to the CPS and they have agreed to drop all charges!
I urge anyone involved in a Crash for Cash scam to immediately phone 999 as the driver in deliberately causing an accident is guilty of attempted GBH. You will find the aggrieved driver soon vanishes! When you do this remember not to clear your phones memory as that will clearly show the time and date you contacted the police.
