Hi All

Hopefully someone can advise what I should do next.

What is the name of the Constabulary? - Essex
Date of the offence: - August 2006
Date of the NIP: - 9 days after the offence
Date you received the NIP: - 12 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A414 Maldon Road, Danbury (near the junction with Gay Bowers Lane)
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - NK
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Not sure when the NIP was received as I did not keep a copy of the letter received or recorded the date so the date entered is not correct however the wizard would not let me continue without one.

On the date in question I think that my son in law borrowed the car with my permission as his car was being used by my daughter as it has an ISIS system for their baby and they won't travel anywhere without it. He thinks he was driving it then as well. We have received a NIP which we replied to however we got another one on the 10/10/06 saying we did not reply to the first one. I basically filed it out giving his name and address details as advised by this wizard. Obviously they claim not to have recieved it and basically what do I do now?

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Did the first NIP arrive within 14 days? - Unsure
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Do you know who was driving? - Yes
Were you driving? - No

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • Complete the Section 172 statement naming the person you believe was driving.
You aren't incriminating them - they'll receive a NIP to complete themselves in due course.
(You might also like to let that person know that they can expect to receive one, and give them the link to this Wizard for when it arrives!)

Any advice that can be given would be helpful in what action I should take next. My son in law fully accepts that he was driving and is prepared to answer the NIP himself however they claim not to have received the one I originally sent back. I have kept copies of paperwork inculding a photocopy of the envelope which is franked and time date stamped.

Please advise and thanks for taking the time to help me.

They are claiming not to have received the original s.172 response or the response to the reminder?

What exactly are they saying?

If they have lost 2 s.172 responses, assuming that they've sent you another reminder and form, I'd suggest filling it in (again) and sending it by Special Delivery.
