Hi.
I received NIP for alleged 58 in 40. I went to police station to view evidence. They have a video of car from front. Dual carriageway, passing another car. Driver visible but not clearly.
My question is, can the video be enhanced and used to identify driver if I return NIP unsigned?
Any help appreciated.

Hi Andy,

The police are allowed to enhance the photos but not manipulate them. If the they have merely looked at the negatives, which they are entitled to do to read the number plate, then that is acceptable.

However, the Regulation of Investigatory Powers Act 2000 may prevent the use of photographic evidence for the purpose of "identifying the driver", and this link will take you to the Act icon_wink.gif
