Full Version: Paid and Displayed in a residents parking space

A couple of months ago I parked in a space and paid for Pay and display.
When I came back to the car I found not only was there a ticket, but hte car was clamped.
I disputed the ticket and the council would not back down as they say that I was illegally parked.

I accept that I did htis as a mistake, and showed that the first three spaces in teh road were marked out pay and display but I did not feel that the signs were adequate, and within the same area they are all so different.

I was also annoyed that I was clamped.

The car was acknowledged at 10.50 and the ticket was issued at 10.55. It does not say what time the clamp was put on, but the photo whcih the parking attendant took was timed at 11.09.

Are there any regulations regarding the lenght of time between a ticket and a clamp.

Unfortuantely the warden took a photo which shows he had his hat on.


I also belwive that the residents sign was obscured.


I wantd to put photos in, but I am not sure how to do this.

I am having to go to tribunal on the 14th of October so would appreciate some help.

I use http://www.imageshack.us for image hosting. Once you upload an image it gives you some code to paste on the forum.

Quite often there are problems with the lines or signs.

Did you get a Fixed Penalty Notice? A Penalty Charge Notice? Some kind of civil parking charge notice?

If you got a Penalty Charge Notice did it have both a date of issue and a date of offence?

Not Haringey, London, their clamping regime is outrageous.

Try to do some trawling for information, try to find if they have any guidelines or working practices.

Check the PATAS/NPAS parking appeals websites for relevant cases.

In Camden, London they are ending clamping as follows:

"A press official said the Town Hall was taking the incident on the chin.
He said: “We are ending the use of clamping in Camden after residents told us they felt
it was an unfair and over-zealous response to minor parking infringements."

thre PCN might not be compliant - post image here

even compliant lines and signs can be confusing

see PATAS bladon v westminster

clamping is a seperate enforceemdnt shceme form PCNs
it is not dependednt on a PCN issue - howver many councils
require a pcn issue fisrt and subsequent period elapsed

you could applea that clamping for such a minor infringemnt
is a grossly disproportionate punishment - see my thread
abou what NPAS said about towing/removal

oif you get the council guidleines for clamping you will
see what they consider fair

under the RTA 1991 though there is no grace period at all

i think you will have a problem - the signs look good

if you still can pay the discount you might go for that

check the PCN for defects first

if past the discount period then wait for Nto it may be defective

Hmm the sign doesn't look quite right to me and they have hidden it behind one telling thieves and pickpockets to beware...?!
I can't read the sign very well but I don't think it should have that black line in the middle.

From what I can see in the second photo the lines on the right are an attempt at diagram 1028.4. There is a huge gap in the lines parallel to the kerb, I recon that (and possibly all the other gaps) is too large.
