Hi everyone,

I’ve received today a PCN 31J Entering and stopping in a box junction when prohibited.

The reason why I entered the YBJ is because the traffic light ahead had turned green and the car ahead of me had pulled off. However the traffic unexpectedly slowed to a stand still very quickly due to unseen heavy congestion backing up on the main road ahead and stopping cars exiting the road I was on even though the light was green.

Basically if I understand rightly having read the above cases I can challenge my PNC on the grounds that the PCN contravention states it happened at 18.33 which if we add seconds to it would be interpreted as 18.33.00 however if you watch the cctv video it clearly shows I entered the YBJ at 18.33.48. Therefore the alleged contravention did not happen at exactly 18.33 as stated?

I’d appreciate any help if anyone can confirm that I understood that correctly or any other advice welcome. Thanks

Well, sorry to say it, but you look totally bang to rights. You followed the vehicle ahead with no hesitation at all and whilst it was still negotiating the junction. Definitely not a win situation, I'm afraid.

We've had these time queries before where seconds are involved, but if you want to follow this up, you'll need a very sympathetic adjudicator, and thats the rub, you'd have to take the matter to London Tribunals and risk the full PCN penalty as the discount option will be lost.
