Got this through but there doesn't seem to be a video to view.

Any suggestions on how to challenge this gratefully appreciated

This is the notorious Shakespeare St "bus lane" in Nottingham that has no bus service down it. There have been several threads on this, and I think appeals were won on the signage, but it is some time ago, so search this forum using "Shakespeare Street" and see what comes up. Unfortunately, unlike London Tribunals, there is no searchable on-line register of cases on the Traffic Penalty Tribunal site. As far as I remember, the council lost an appeal based on incorrect signage. However things may well have moved on since previous cases.

I'm pretty sure the got their rotten house in order after this JR

Where the reason for the TRO was made clear to be a pedestrian zone not a bus gate ( the council cannot enforce ped zones so want it to be a bus gate) but it would be a good idea to get the amended order. If they have just changed the signs then the order might be ultra vires

They also use an 0845 number. an argument that this has been ruled illegal can be made. This has not as yet garnered much support at TPT but we are working on it and IIRC the last time it was put to Nottingham the backed out

So are we saying that although it isn't a bus lane NCC have now got the correct signage up and therefore there is no way so successfully challenge the charge ?

There was special routing and parking restrictions in place that day due to University drop offs but I cant recall exactly what now

Without sight of the TRO I do not know. If the TRO is still for a pedestrian zone then yes you can challenge, it the TRO have been altered to bus lane you might challenge the vires of that order, or you might challenge the signage we do not know what is now in place

Seeing the no entry sign it does look quite clear, although I don't recall seeing it

So i guess I will have to pay up and shut up unless anyone knows of a get out ?

It looks like they have amended the order to create a bus only street.

What needs to be examined IMO is the vires to do so, was it done properly(most likely ) and if the correct signs are used given the single exemption.

I've made a FOI request to try and get a copy of the contract between the council and Cobalt Telephone Technologies Limited, whether it will provide sufficient evidence to pursue the 0845 ground I do not know.
