Please do not post personal details for obvious reasons - fairly certain its going to be for overtaking a couple vehicles travelling around 40-50mph on a 60mph road was behind a van made sure oncoming lane was clear before starting to overtake the van in front of me, as i started to get level with the van i noticed there was a car also in front of the van that i would have to over take to proceed at this point there were a few cars in the oncoming lane approaching at speed at this point i was unsure of what to do so i accelerated to try and cut in front of the vehicles in my lane as this would be safer then slowing and hoping i could cut back in behind the van managed to cut in without having a head on collision although it was a bit too close for my comfort obviously received the nip today and i'm concerned that this is a really serious matter

  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

    You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

At this stage you are simply being asked to provide the driver's details. You must do that to avoid committing a separate offence. Do that and see what, if any charges are preferred.
This is a serious matter if you are charged with dangerous driving, but there is a good chance they will drop it to careless, or at least will be willing to do so in exchange for a guilty plea.

If they do persist with Dangerous Driving then you may wish to consider a solicitor. There is a statutory (lower) alternative of Careless Driving.

If convicted then there will be a mandatory ban of 12 months with a retest required. A custodial sentence is possible but unlikely.
