Full Version: Challenge refused -parking on residential bay PCN invalid sign?

Hello,
I have just got my PCN challenge refused for parking on a residential bay from Kensignton & chelsea borough...
I have challenge the PCN since I parked less than 2 meters away from a Pay&display sign and white demarking lines were not clear at all....
note that my car is the one on the left (within the picture) and it was Sunday at 1.30pm therefore outside the Pay&Display times.... 5 meters away there was an other sign saying that was a residential bay (I obviously did not see it when I parked there...)
Do you think this is enough ground to go head to the tribunal? what is your advise? it seems that common sense is not considered too much when it comes to council & rules enforcement....
your opinion and experience would be highly appreciated...

These are the exact wording
"Where a residents bay is situated next to a pay and display bay, double white termination
markings are used to separate the two bays. Within each bay there will be a time plate
indicating the bay type.
Pay and display bays have individually marked spaces for vehicles to park in. Resident
bays do not usually have these markings.
The Council contends that where termination markings are in place, it is the motorist’s
responsibility to check the time plate within the parking place that the vehicle is parked in.
A sign attached to another bay is not relevant to the parking place even if that sign is
closer to the motorist’s vehicle."

On the basis of what you've posted, no!

The photos will show. GSV shows them to be clear.

Substantial compliance and visibility to a reasonably diligent driver will be your legal hurdles.

Entire text for refusing the challenge:

"
Thank you for your letter regarding the above Penalty Charge Notice (PCN).
I have looked at your case and I have found no grounds to cancel the PCN.
The PCN was issued as the vehicle was parked in a residents’ parking place without
clearly displaying a valid resident permit.
The Council is obliged to manage the large volume of traffic carefully, using our limited
road space at all hours on a daily basis. This is especially the case with regard to resident
parking bays where demand far outstrips supply. Many of our residents have paid for a
concession to use these bays and they expect us to take enforcement action against
vehicles parked in contravention.
Where a residents bay is situated next to a pay and display bay, double white termination
markings are used to separate the two bays. Within each bay there will be a time plate
indicating the bay type.
Pay and display bays have individually marked spaces for vehicles to park in. Resident
bays do not usually have these markings.
The Council contends that where termination markings are in place, it is the motorist’s

It is a driver’s responsibility to check the nearest sign plate within the bay the vehicle is
parked and to ensure that a vehicle has been correctly parked.
All parking restrictions are marked and signed in accordance with the Traffic Signs
Regulations and General Directions 2002. It is the responsibility of the motorist to ensure
that they are parked correctly at all times.

anybody think that parking less than 2 meters away from an other sign is not a good reason to appeal?

You've seen the photos and the white lines which are brighter than teeth in a toothpaste advert.

Where's the PCN and their reply?

Don't transpose docs into posts, just post the entire doc including dates but less personal data.
