A bit of a random question but is there anyway to Complain against the DVLA selling out peoples details to parking companies.

As i thought this would breech the Data protection act and GDPR.

Protection of Freedoms Act says that companies MUST obtain details from the DVLA to recover parking charges
I don't see though why the DVLA shouldn't be required to notify keepers of such requests and increase their charges to the parking companies accordingly

ICO has told me on several occasions that it isn't a breach of the DPA/GDPR to retain and pass on the details for the purpose of recovering payments
even when the company knows that it has no right to the payment

There's also been a court case involving PCM UK where the court decided reluctantly that PCM were entitled to process details if they believed they were entitled to a payment no matter how unlikely they were to succeed in court.

But as i understand that is like me buying someones information and doing research on that individual. However did i sign consent for my information to be distributed out.

Clearly that would breach Data protection as for selling peoples information.

I`m not having a pop at you Redivi really not just being curious as i would like to put a complain to the DVLA.

This is one of the reasons I never register as the registered keeper and I also refuse to be on the electoral role until the Council assure me my details aren't shared with credit reference agencies.

I thought there was some consent statement hidden at the bottom of the V5?

It says "Your information may be disclosed in a number of lawful circumstances".

In terms of Data Protection (DPA/GDPR) consent is “any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her”.

The registered keeper has not given consent, but as I already stated the basis for the data release is not via consent anyway...

When you own a car and drive it you are subject to a lot of legislation governing all sorts of things. Car ownership is ultimately optional and if you don't agree with the rules, you can not own a car. If we were all allowed to opt out of the parts we didn't like we'd end up with the FMOTL nonsense about having a right to travel with absolutely no responsibilities or contribution to the costs of providing the road.

I think he is just regurgitating pub talk, more commonly known as "talking sh*t".

It is the current keeper who sends off the V5C, not the new keeper, and I can't imagine they would want to miss out on their car tax refund.

If you aren't on the electoral roll, then your credit rating is rock bottom anyway. Seeing as no-one needs to apply for credit, you are just disenfranchising yourself for no good reason.

So for anyone with functioning brain cells both courses of action are incredibly pointless.
