NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - No
Is the NIP addressed to you personally? - Yes
Although you are not the Registered Keeper, were you the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Hi Guys

My company recieved an NIP about 5 days after the alleged offence. They then posted it back with my information within 5 days to the police. I then recieved the NIP about a month and a half after it was originally posted from the company car people.

I recieved only a reminder NIP (no original or form has ever been recieved).

Should I call them up is that the best course of action? If I have no form how can I send the info, can I e-mail them?
Can I ask for a speed awareness course? thankyou.

I was allegedly doing 39 in a 30.

1st NIP was served within 14 days, so the fact that you've received only a reminder doesn't change anything.

Simply return it naming yourself as the driver. A SAC should result.

Any questions?

Speeding presumably? Alleged speed? Limit?

1st NIP will have gone to leasing company, so the fact that you've received only a reminder doesn't change anything.

Simply return it naming yourself as the driver.

There is no form in the envelope, it's just the nip reminder.
Is the best thing to call them at this stage?

it was 39 in a 30

Most forces won’t accept an email response - but you don’t have to use their form as long as you provide the required information and signed.

Best course of action would be to ring them and explain - they will likely agree to send you a form.

There’s a limited time to take a course so best contact them asap.

So no form to complete and return was included with the NIP, but the NIP does request driver details under S.172?
Redivi
You don't have to use their form

You can send a letter as long as it has the required information :

Full name and address of driver
Date of birth and Driving Licence number
Signature

Send it from a Post Office and ask for a Certificate of Sending

So no S.172 to complete and return was included with the NIP?

I only recieved a page 1 NIP which was 5 days after the alleged offence, the lease company said they couldn't send me anything else (i only found out they recieved this but didn't notify me until i called them).

the only letter i recieved was an NIP reminder letter, nothing else has been recieved,
I'm not sure what else I can do at this stage as I was supposed to have returned it within 7 days of the reminder letter, and 3 days have already passed.

Is thr NIP in your name? You shouldn't have received anything from the leasing company.

Shall I just hand write my details? Can anyone advise what should be in the letter that I post to them? Thanks.
Jlc

Personally, I'd call them first.
