Full Version: PCN01 Manchester incorrect location on PCN

Hello,

Can anyone please help.

I visited Manchester today and parked on Charlton place. Most of my car was within a car park and drivers side wheels were on a broken single yellow line.

I did not see any sign to state there were parking restrictions during prescribed hours.

I was monitored parking there for 11 mins.

I was dropping something off so unloading for that length of time as I had to deliver to the second floor.

The PCN states I was located in CHORLTON place when I was in fact parked in CHARLTON PLACE

So can you please advise what the best form of appeal would be. Can I appeal based on not being in CHORLTON place and therefore the PCN is invalid on a technicality?

Post the PCN. Use a site such as Imgur or Flickr.

Wrong location can be fatal and it looks like it will be in this case. You mean Charlton as in Bobby...

It helps that Chorlton is a district of Manchester so hopefully 1-0 to you.

Loading is also an exemption but 11 mins will have to be justified.

An error of that magnitude should invalidate the PCN, however it is not unheard of that an adjudicator would find that you knew where you parked and the error was insignificant

IMO your photo of the line would dam you, the lines would be found substantially compliant.

So lets explore the loading/unloading. This is a statutory exemption. It is for you to prove it applies , so can you?

I'm usually so careful with parking. I initially parked too close to the corner so moved the car and the person I was dropping off to said the car would be fine there. I stupidly took their word for it. I honestly didnt see the signs xx

Yes a pic of the PCN. Redact only your reg and PCN no Pic of both sides.

As regards the dropping of, what was the item. The proof is the balance of probability and a letter from the recipient confirming that you were delivering to what address etc would help If you were delivering something and you needed to do it by car then use it

Yes - the PCN may have other faults. We always want to see them.

your car looks a tad small to be carrying a heavy load...

Set Flickr pics to public, not private, view.

Yes - the PCN may have other faults. We always want to see them.

There is a place Called Chorlton Place in Manchester but its a Care Home x

You can appeal but I doubt they would just roll over, so you'd have to take it all the way to the Traffic Penalty Tribunal.

make a challenge - they will reoffer the discount initially if they reject so it's no risk

is car registered to you at your home address

Challenge on both the unloading and incorrect location. The answer might just hand you a win
